Besides, a lady from HO once mentioned that caseworker get the ILR files on the basis of bio date and although they consider 6 months limit on the basis of app date.
@effell007, you probably right!! how HO prioritize the ilr apps, is the biggest secret of 21st century . There is big variation among each application when you look at date of application and date of decision??

I will highly appreciate for your help and advice:
I am in very difficultly position.I was a student, living in UK with my wife and 2 year old son.My visa was refused on human right ground. My appeal's hearing in First Tier Tribunal was on June 2014. 5 month before the hearing date on last January 2014, I changed my solicitor and present solicitor informed Home Office and tribunal about the changes and he represent me in the hearing.I did not knew the decision until I phoned Tribunal on 2nd week of August 2014 ,they told me Tribunal dismissed my appeal on first week of July 2014 and I was also shocked when they said they sent determination letter to my previous solicitor's address.
After many correspondences with Tribunal,Tribunal re-issued decision letter on first week of December 2014.Then we sent permission to appeal for Upper tribunal to First Tier tribunal within 14 days.Middle of January 2015 I phoned First Tier tribunal to know about the outcome and they said they haven't received my permission to appeal for Upper tribunal.but my solicitor said he have proof,he have the receipt from fax machine that he sent the permission to appeal.now he is contracting with First Tier Tribunal.
First week of august 2015,I will qualify to apply ILR on 10 years ground.I am very much worried that Home Office could say I have the gap in continuous residency during appeal process.I needed to kill those time to qualify for 10 years route.does my solicitor intentionally doing this to spent those time, why he is not telling me then ? or those issues occur because of lack of his responsibility ? how can I over come from this situation ?

I will highly appreciate for your help and advice

Hi mate good luck advance wishes to you at last it's confirmed now November application start prosesing ..good news .

It is really frustrating, the quality of information from the call centre is appalling. I rung home office today twice and spoke to two different people and both of them said that the home office is still looking at the Oct applications and they had the Monday update from home office. Either they don't tell us correct information or they don't have the correct information. Either way just horrific. On the other hand, this forum is a great tool. Please keep it running for others to come. I applied on Nov 8.

Every thing is from Allah

Well problem with ILR after withdrawing appeal is in case they refuse they we get no right to appeal
Plus no right to work once appeal is withdrawn

If God willing appeal allowed then ILR

Visit visa counts

Just checked

Left the UK during half term for less than 28 days in which I Varied to student visa in India came back within 28 days . Got a letter from the college
I think it says continuous lawful stay . Said my supposed amazing lawyer

I withdraw my appeal .before I made application . Done on sameday

I dislike appeals they take a very long Time even when u win , they take forever to issue u a visa which might not be ilr .

So I decided to go for a fresh application .

Thanks brother

My self

Came in dec 2004

Student till 2012 march

Psw ti 2014 march
Applied flr fp but refused and appeal in Feb 2015

Told HO Presenting officer and court that finished 10 yeAr finish liuk and English test too in dec 14

But again appeal shifted to July because of lack of court time

Why u applied ILR in oct ? You came student in Jan 2005

Does visit visa count to 10 year ?

Also why appeal pending who advised you to apply ILR ?

New application can't be made if appeal pending
fameface wrote:came to the uk in 2004 aug with a visitors visa, was advised i could change over to a student visa by my college, was not allowed to by the ukba citing change of law. i went back to india, on the 13th dec 2004, came back to the uk on jan 2015 on student visa

After that i have had a 6 yrs student visa and 1.3 years section 3c . 3months student visa and 2 years psw. In jan 2014 sent in flr fp, I applied for flr fp was expecting a British child from ex partner and had massive economic ties in the UK . Was refused citing general grounds .and baby not born yet for human rights consideration ... Appealed . In the process completed 10 years thanks to the home office. Became a father

i sent in my application to the home office in oct 2014, based on the 10 years route .5 days before my appeal in nov 2014 .

Sentence was a fine in 2008.
Conviction was far spent . Even cited conviction had been disputed before by the seceratary of state , I won and it was found it was spent .. Was shocked when my flr fp was refused .

Moral of my story all my troubles was a blessing at the end .

Hello Brother

Same case like you

Applied flr fp. Refused and now appeal and 10 yeast finish

Sent additional grounds already to both parties

Appeal in July

Please throw some light about your case

Applied on the 21 oct 2014
Bio received 13 nov 2014
Enrolled in the 18th nov 2014
