Hi putiniPutiniEEA wrote:Sorry to hear that Nora
Was it ur first application??
Did u get right to appeal?
Nora: BOTH PASSPORTS. As it clearly says on the guidelines here: https://www.gov.uk/apply-for-a-uk-resid ... st-providenora_804 wrote:Hi putiniPutiniEEA wrote:Sorry to hear that Nora

our first application was sen 14.04.2015, and now we have right to appeal.
I saw this on the website :
Issue of residence card
17.—(1) The Secretary of State must issue a residence card to a person who is not an EEA national and is the family member of a qualified person or of an EEA national with a permanent right of residence under regulation 15 on application and production of—
(a)a valid passport; and
(b)proof that the applicant is such a family member.
What they mean with a valid passport, is it for me how is EEA national or for my husband how is non-EEA? Anyone have idea what they mean with that?

In making the decision to refuse your application consideration has been given to the following :
• EEA 2 Application
• ARC card
• Norway passport, returned to applicant
• wick & Co Solicitors, no longer representative
we are so confused, do they mean that we have send only this evidence
No, they did not come on a home visit. The only Home office did they called my employer.PutiniEEA wrote:--------------------------------------------nora_804 wrote:Hi putiniPutiniEEA wrote:Sorry to hear that Nora

A) valid passport means - it should not be expired , it should have validity.
B) family member - marriage certificate is right thing to prove that including day to day relationship history such as travelling together, living etcetera.
Did they do surprise visit during application??
If not then we can't say that ur marriage is suspected, I think u and ur husband should provide more details
We send them both, islamic marriage and the british marriage certificate. My Norwegian-passport was sent to them. We have no childrenVensai wrote:Nora,nora_804 wrote:I know that, but what they mean with:mmalinconia wrote:it's strange that they don't list any other documents you sent, such as marriage certificate.

In one of your earlier posts, I thought the Home office made reference to your Islamic marriage certificate. did they not?
Other thing apart from marriage certificate is your passports. Do either of your passports have the spouse name listed in it? You can call attentton to that. If you have children, you can also include thier brith certificates which will substantiate with Father/Mother names.

Hi 10z and tati10z wrote:hi nora
did u send ur husband passport
what is his visa status,
and r u was working during application.
it is not easy as you think. The embassy must have explanation how it has been for the previous passport and it takes them 4 months to create new because you must have confirmation of all certificates as birth certificates, registry certificate +++ Believe me, we've tried to get in touch with embassy to my husband they are not so helpful. The easiest way is to get the old passport to just renew it. But now we have to go the hard way to get a new passport thanks to Home Office10z wrote:hi nora,
thats the reason for ur refusal, coz in EEA FM cases, they need a valid passport not expired,
so even if they have ur husband,s passport but that is expired now,
ur husband have to get new passport from embassy ,
that why they mentioned 17 (a)and (B)
one is about marriage certificate
and other is for valid passport
so try to get a new passport before u go for a appeal or new application,
My husband got COA with right to work, and people bad history is made by Home office. When people send application and send everything of documents and paying money to the Home office because they will live legal in the country. Then comes home office and makes their life with hell of problems, HO is losing their document, they give them refused, they are taking money, they spend more than 6 month ++++ many good people is stuck because of the home office mistakesPutiniEEA wrote:Nora

I know some people who Are waiting from 18 months. Strange
Every time they do call to HO, HO SAYS under processing.
Especially, people who have bad history

if u have a photo copy of old passport, take it with you to embassy, they should be cooperative, and don't scare of them , they can't send ur husband back,if u want just get a police report that u lost it,
or show them the home office letter which they says that they have ur passport.
which embassy ur husband have to go Norwegian?
try to show them ur marriage certificate ,at least he is the citizen of that country ,try to convince them.
best of luck
