10 years long residence applications

My ILR on 10 years residence application is refused with appeal right.

The reason is that - I had an application on 22nd January 2007 for SEGS and they could not take money from the credit card. They refused the application on 24 january and gave 28 days to re-apply. Unfortunately, i did not receive the latter with my document. at the beginning of March 2007 i have called HO that I did not here anything and they replied they have sent the application long ago and could not gave any ref how can i get.. asked me to contact royal main..I contact and collect..I called HO again that 28 days is already over they say just fill the payment page and send the document..I got visa..

I applied SAR…and it says that in the summary there is no overstay for more than 28 days..but the application acceptance and rejection was mentioned on the time line..

I have been here 9 years as student 1 year SEGS and did MSc with Distinction and just completed PhD…

Any advice, help or how to appeal..or anyone been through such situation…please please…christmas holiday is approaching.

Following my above post. My appeal was allowed by the judge on 20 March 2014..So far I have not hard anything form HO..I called them this morning and the lady said the application is not with the case worker yet..I called my lawyer, he said he will write a letter to HO regarding this matter.

During my conversation with HO, I told them the time line for the court determination to got to case worker is 4 weeks and she said "There is no time-line!".

This really important to the visa ASAP..it's been 8 month since the application..can't wait anymore..need to get a job..get my life back!

I also had a invalid application due to the payment long time back in 2007 for which i don't have any HO letters with me at the moment , probably i have thrown them away during house moved ....bit worrying about it though ...

My wife came to the uk in 2010 on my tier 1 dependent which is still valid till July 2015.
My question is that whether she will come under old rules or new ruled whic is 5 year waiting period.
I have been to 4 solicitors to clear this issue to be honest they dont even have the answer ...I dont know totally confused ur guys help much appreciated....

But couple of experiences in this post for pre July,12 dependents applied FLR(M) after 06 April 2014 at PEO and switched to SET(M) in a week. Please Comment.

As Amber rightly answered you that any one applying for their dependants after 06th April 2014 will be under the new rules, hence a 2.5 years visa after the FLR(M) which could be extended to a total of 5 years, so that they could spend that as their qualifying period for their SET(M) for indefinite leave to remain.
In your case your Mrs is pre July 2012, and though rules are quite clear but you know, with the quality of case workers that you get at the Home Office, just yesterday two members who applied for their dependants, who were pre July 2012, and pre 06th April 2014 got completely different visas, one got a 2 year under old rules, and another got a 2.5 years under new rules. I mean to say you never know if you get lucky and get a 2 years one. Please keep following the cases on this forum and that will give you a clear idea of what is happening.

Many thanks Shahjee lets c.As I mentioned I been to 4 soliciyors they dont no either.one of the solicitor told me pre july 2012 dependents are excluded from this new rules but ehen I asked him about any ref he had nothing in written .I was thinking to withdraw and wait one year to get ILR with my wife on same day but its too late now.I think my friend is withdrawing his long residency case on monday which he apllied on 30 Feb....

I had same points as you got .it depends if you were given fixed penalty and you paid to on time without going to court the you are fine .and you dont have to even mention it in your application coz i never did and i received ilr without any problem.

I did confirmed with the Home Office and the customer advisor said that my application is with the case worker, don't know how long does it takes for a case worker to decide, but you right it is anxious times. By the grace of Allah my ILR has been granted , just wanted to inform u guys with my timeline if that will help anyone .

application sent : 30th jan 2014

biometric : 20th feb 2014

ILR granted on 14th may

docs rcvd : 15thmay

just wanna ask is it necessary to send 10 years history i mean old mails or college letters or just life in uk test and degree is enough with form and passport.
