Hi Tehmina, tehmina wrote:One of our family friend lodged appeal on 01/04/15
And review date is 27th August
He called on that no 0113..but they are saying we didn't get any document about court hearing so there is no decision yet.
He also ring on paid number to esclate but they said we don't deal with appeals etc
It's just 2 more days left and lot of other people who lodge appeals after him got either court date or got call to submit passport
What should he do any suggestion? What's likley the reason

@Khan81 thanks a lot for updating your time line on the forum. The time looks pretty much similar to mine and stillwaiting123.
@stillwaiting123 have you heard any thing back from the FTT regarding your application review ????
I just wanted to ask if any one can tell me what the paragraph below means it says on the review notice I've received from the FTT
To the Respondent
"A Notice of Appeal was lodged on 26 June 2015 against the respondent. A Copy of the notice of appeal is enclosed.
The Tribunals directs the respondent to send copies of all the documents to the Tribunal and to the other party, to include a copy of the notice of decision to which the notice of appeal relates, and any other documents provided to the appellant giving reasons for that decision, together with any statement of evidence, application form, record of interview, or any other unpublished documents on which you rely, to arrive within 28 days of the date on which you received from the Tribunal a copy of the notice of appeal and any accompanying documents "
I am confused about the above paragraph. I would like the respected group members/experts/gurus to help me in understanding the above paragraph.
Many thanks for your useful reply.
Remember me in your prayers and I'll also remember every one in my prayers.
Good luck to every one for their appeals/spouse visa application.

but if you read it carefully the Tribunal is directing the respondent in my case the respondent is UKVI

The Respondent is UKVI not me or my lawyer/representative am I correct in saying that.
Waiting for your useful replies.

Hi March2015,Hi
What this means is that the respondent (UKVI) are instructed to send their grounds for upholding their decision along with any supporting documents to the Tribunal within 28 days of receiving the notice of pending appeal - this is what us suppose to happen but as we can see it doesn't happen in reality. They take way longer up to and past the review deadline after which the tribunal just sets a hearing date.

His chances were very slim but alhamdulilah he got the visa, all this about there is little hope etc is nonsence there only decision maker is Allah so put your faith in his hands as Allah knows best and if you know someone going hajj as them for duas
I think you should stay focused on your appeal and not hype about hammering for any amount. Even after the appeal process has ended, you should focus on the future/family life instead of (if you do) filing a claim for £10k-£30k (or any amount) and spending further more years paying legal fees and stressing over the whole case.Annonymous wrote:Hi i.need.help
When you make a claim you don't claim for the Original amount spent you need to add personal damages and legal compensations to the amount claim as well.
Have you ever made a personal damage claims in the court if not then you need to get knowledge around this area first that how you make the claim.
I don't think that any body would have asked such a "stupid" question what you have asked and I never said in my post that I have spent that much on the legal fees. I just have said that I wish I can hammer UKVI for the amounts. Just a good piece of advice think before you are asking any thing read my post carefully and I never ever said that I've spent these amounts.
I don't mind really and I don't really care if you don't reply to my post but I do take this in to serious consideration that when some one reply for my post must have read it carefully before pointing their fingers at me.
Just a good piece of advice think before you are asking any thing read my post carefully and I never ever said that you said you will be making a claim.Annonymous wrote:Hi,
Thanks for your advice I'll take you advice on board.
I am staying focus on my appeal I never said that I am claiming any sort of damages I just mentioned that I wished if I can possibly do that I'll be the first one to do it.
I am so frustrated from the poor performance of UKVI that it just drives me mad. I've shouted enough time. Personally Contacted Keith Vaz the Chairman of the Home Affairs select Committee regarding issues of UKVI. Also raised the question about the extremely poor and appalling performance of UKVI as compared to the amount charged in the form of fee in the PM question times as well.
Nothing really seems to be working even after all of my complains, well in a way I do also feel sorry for them cause I've personally attended the preceding of the Home Affairs select committee Chaired by Ketih Vaz when I was working for BSKYB at that time Brodie Clark was the head of UKBA and he said clearly that he can't help it with the no of staff available to him at that time and what the Government did is made it more difficult just by dividing the staff now and making two different government departments instead of increasing the no of staff which will help them in solving the problems I am not claiming that I'm clever than everyone else but the Government decisions are just full of stupidity and they just do it in an attempt to reduce cost and they'll end up spending more.
I do really apologies from you unreservedly if you find me a bit harsh. but its just a fact that you are really not aware from my share hard work around improving this Govt Dept.
stillwaiting123 wrote:Basically once u have lodged an appeal (within 28 days of when u get refusal) you get a confirmation that they have received it, then normally 1-3 weeks late payment is taken from your bank account (£80 paper hearing. £140 oral hearing) oral is best (in my opinion) as a lawyer can represent u and give your side in court whereas a paper hearing they go with just everything u have provided on paper.Annonymous wrote:What's this means review deadline ???
What will happen after that deadline will reached ??
Many thanks waiting for your useful replies.
Once payment has been taken it takes 4-6 weeks for an appeal notice to be sent out, this is sent to Islamabad embassy and yourself as well the lawyer (if u have one). On this appeal notice is a review deadline (15 weeks from appeal notice e.g i received mine 14th July and my deadline is 27th October) during the review period the ECO has the chance to re look at the papers with the new proof/supporting documents u have provided, this normally takes 4-8 weeks sometimes even less and if they are satisfied then decision is overturned and appeal is withdrawn and they call you to submit passport within 10 days.
however if review is not successful then they refuse and u have to wait for a court date which can be anything from 4-6 months
