PR Application for children under 16

Post by SRE » Fri Oct 07, 2016 10:34 pm

Hi,

I am a non EU citizen married with French and we have been living in UK for more than 5 years. And now me and my husband want to apply for PR. We are still working on PR form and also their documents and soon we going to send it. But I have questions, do I need to apply PR as well for my 2 kids? both of them still toddlers. I am planning to apply PR only for me and my husband, and in the form there is a question that I have to explain why my kids is not included in the application. Is there anyone can help me answers the question? It would be very helpful, if you can help me. Thank you

Where were children born?
For example, if they were fortunate enough to be born in UK (before you were settled) they don't need PR as once a parent is settled they may be registered as British citizens.
If you were already settled when they were born they will be British already.

Hi, both of them born in UK and have French Passport. Planning to apply British passport for them later after we have our PR. Is it ok if I don't included them in our application?

They don't need PR.
Depending on DoB they are either British now (shoot for passport);
or else entitled to register as soon as one parent acquires holy grail of PR; (apply passport later).

That depends... Did she return to work after maternity leave? She could have retained her worker status based on the St Prix right.

Hi, I'm looking for some help with PR application and I hope you guys could do that.
Me and my husband (both Romanians) came in Britain September 2007 and started working as self employed straight away with an yellow card. Then in July 2009 my husband started to work as an employee with a blue card and had the same job until October 2015 when he started studying at college. We didn't took out comprehensive health insurance as we had no idea about it. If I make an application for PR card will they consider the years before he started studying or will they ask for the health insurance?
Has someone here been successful using the simple EEA3 form ?
Thank you very much in anticipation.

A RC is not a visa.

Applying '3 months early' is meaningless and does not apply.

Apply when you have acquired PR - not
before.

How long married?
How long in UK?
When did sponsor become a qualified person?
Any prolonged absences from UK?

Are there any people from May still pending?

My timeline goes as follows:

Application sent: 17/05/2016
Confirmation email: 15/06/2016
Documents Requested Back: ?
DCPR dated: ?
DCPR received: ?

I need to request my documents back, does anyone know how to do this, and if it will delay the process in any way? Thank you

Hi and welcome on board,

please use the below link for your request,
https://eforms.homeoffice.gov.uk/outrea ... ments.ofml
and it takes 10 working days! good luck
by the way now days EEA national can even use the new service when applying for their PR which is called (European Passport Return Service)
https://www.islington.gov.uk/birth-deat ... rn-service
that's just an example, but it can be in any local town hall for the cost of £15

You should have acquired PR last month then (5th wedding anniversary), assuming you were based in UK by then.

Spouse/sponsor should have acquired PR in 2014. If no DCPR suggest wife gets one (with all wild talk of Brexit and one thing and another).

Hubby may be able to use the blue/yellow card to invoke a transitional arrangement for students;
if so, no need to show CSI if the card was issued in/before 2011.

See https://www.whatdotheyknow.com/request/ ... issued.pdf

Yes, the earlier (simpler) forms have been issued successfully.
The current 'monster' form is not a legal requirement.
Whichever form you use, you still need rock-solid evidence to back your case.

I dont rember fory all holiday dates in the pst 10/years..is that a failure?

Section 9.1 which is me? No or not applicable?
Thanks
Earlier, simpler form:
http://www.immigrationboards.com/eea-ro ... 17223.html

Online form is a new service, google it.

If staying loyal to current, monster form, section 9 applies to the person who is the EEA natioanl who exercised treaty rights. In this case, that's you.
For absences, list month/year if you can't remember precise dates and did not keep records, booking details & etc.

But simplify your life, look at shorter form. See which floats your boat.
Great! Thank You!

When i fill his form (simplier) setion 3 shall i give the first 5 years or the last 5 years or All 10 years i have been here and worked?
I have the inoration , if i proove my first5 years, than the residence card will be backdated to 2012. Is that right?
Thank you

The form only asks for last 5 years; presumably it assumes you apply as soon as you think you have acquired PR.

It is quite legitimate to apply based on a previous qualifying period from 'back in the day'.

You could include all details of your timeline, over all the years you have enjoyed in UK, on a separate sheet if you wish.

Yes, if you prove you had acquired PR back in 2012 then hopefully that will be recorded as such in your record in the HO databanks.
The card won't actually show it - the card only shows date of issue/expiry.

May I respectfully disagree with this point - transitional arrangements apply only if you were granted the yellow card as a student before July 2011. However, for the person posting above, he has acquired PR before he became a student, so no need to worry.

Hi,
Does anyone know can you travel outside UK while waiting for a decision. I am non EU applied for PR card with my EU husband. I requested my passport back and want to travel back home but wondering would it be a problem coming back to UK with expired residence card and without my husband?

Thank you all

OP may have PR (if work was genuine/effective and no prolonged absences) or they may not.
If so, all good. Subsequent activity is immaterial (if PR has not been lost).
If not, its useful to know blue/yellow cards may be a way out of a 'OMG no CSI; noone told me'-type scenario.

This is my biggest worry, I need my passport back before Feb 2017 as i have a wedding abroad to attend. Has anyone received any problems?

the website says i should receive my documents back within 10 working days. The Document request form is only for documents that haven't been returned within the 10 working days? I haven't received any HO acknowledgements or confirmations so i have no reference numbers etc to refer too. Is this normal?

Hi there,

Not sure why are you worried when you have just submitted your application (wait at least when the money is taken, and then confirmation email (it's normal if you don't get it) and then request your documents, they may take more than 10 working days, you may have to do it again! Also you are talking about Feb 2017, that's far away, and I am sure you will get your documents before that date or even your DCPR will be sent to you by that time! will advise you to sit tight and wait! Imagine if you have already started worrying about it now, how about in 3/4 months time! go slowly mate!

Turns out the 6 months starts from when the payment is taken.

Called the Home Office today they took my details then promised a call back in 5 working days.

They called back few hours later to tell me that nothing was sent out yet, the case is in progress and the 6 months is just an approximate processing time so I should just wait longer. (At the very least I managed to confirm that my address change went through but that's all)
