Hello guys

I am in a similar case, living in UK for 9 and a half years, married for almost 5 years to a EEA national and we are separated now for about a year and she is refusing to help me or start the divorce procedures. I have been working full time for more than five years and before that was studying full time and working part time. I am interested to know what will happen if they refuse my application to a Permanent Residence, I need to renew it in 4 months. Do I need to leave the country or can they just deport me? Even with all a good work and comunity history? Would be very grateful for some advice.

Dont get it, you must have really been a jerk for her to not want to divorce you . Guess that's the only thing she's got on you

It is not the case, I had to make a few trips to my country because of a serious illines followed of the death of my father and she though I was seeing someone over there, what is not true.

You can relax: they cannot deport you. The European right of free movement protects you even if you do not have a residence card, as long as your spouse is living in the UK.

But you may run into a lot of practical difficulties, and travelling abroad would be next to impossible. So you should try to sort this out. You could try to work it you with your spouse, or if that is not successful, you can initiate the divorce yourself. As far as I understand the UK law, it could take up to five years for the divorce to go through, and in the mean time you have to hope that the Home Office takes a benevolent interpretation of your status.

Thanks for your help. I am trying to get her help or at least start the divorce process and I hope she will reason as she does not want to have any problem as well. Do you thing I could try and send my application with a cover letter explaining that we are sepparated and she is refusing to help me? I work full time and I am sure the company I work for will ask about it as they know I need to renew my residence now?
