Statement of changes at 7.17 page 92 wrote:7.17 Changes to requirements to provide bank statements are being made, to allow
electronic bank statements to be submitted for all bank accounts, not just those which are
exclusively online accounts
Effective from 1st October 2013. Though as per:
Annex FM 1.7 wrote:3.3.4. Bank statements must be on official bank stationery. Alternatively electronic bank
statements can also be accepted for all bank accounts (the account itself does not have to
be exclusively online) as long as they are either accompanied by a letter from the bank on
its headed stationery confirming that the documents are authentic or which bear the official
stamp of the issuing bank on every page.

Visa Extension for my wife and other options !

Post by plaistow » Tue Jan 19, 2016 1:44 am

Hi

I am a British national and living with my 3 kids who are also British national but my wife had visa until October 2016 than she has to apply for further extension.

My question is that my Mrs came to UK in September 2008 and stayed here until November 2011 and she had to return back due to her country due to parents health problem and she stayed there few months.

She was back to UK Jan 2014.

That's mean her indefinite qualifying period was finished because of her absent from the UK. Still had 1 year visa remained on her passport when moved back.

I was wondering if there is any law exist or any compassionate leave she can apply to get her ILR otherwise she still need to have 2.5 year dependent visa. My kids are 7, 4 and 1 years old.

Please advice.

My question is that my Mrs came to UK in September 2008 and stayed here until November 2011 and she had to return back due to her country due to parents health problem and she stayed there 1.5 years.

She was back to UK Jan 2014.

I was wondering if she can apply for permanent residency or there is any law exist she can apply to get her ILR because she stayed here 3 year between 2008-2011- and plus 2.5 years from April 2014

My kids are 7, 4 and 1 years old.

Please advice.

You have to look closely at Appendix FM-SE and Appendix FM1.7 to determine what specified evidence is acceptable.

Thanks Vinny

According to the guidance note:

(a) Bank statements must:

(iii) in relation to personal bank statements be only in the name of:

(1) the applicant’s partner, the applicant or both as appropriate; or

(2) if the applicant is a child the applicant parent’s partner, the applicant’s parent or both as appropriate; or
(3) if the applicant is an adult dependent relative, the applicant’s sponsor or the applicant, unless otherwise stated.

That mean we can provide same bank statement as a partner.

Please confirm.

Yes, I think that both earnings are acceptable, subject to the requirements of Appendix FM-SE, etc.

We both can get the salary into the same account ? Shouldn't be the issue as stated in the guidance when related to each other.

You may have to explain why your wife's earnings were credited to your account. The crucial thing is compliance with Appendix FM-SE. You should read it very carefully.
