Please help clarify some questions on my ILR application

Please help to double check my ILR application

Hello,

Thank you for all your help. I'm just checking through the application a final time before submission. I want to run through it quickly with you, just in case you can spot something that I should be aware of. This is an application for me and my husband and child as dependants.


Immigration history:

- I came to the UK over 10 years ago to do my PhD. During this time, I came back to my home country to get married/had a maternity leave. I came back to the UK with my husband and child as my dependants and completed my PhD 6 years ago. I was on Post Study Work visa when I was offered a job. I moved to Work Permit visa exactly 5 years ago today
- I have been with the same employer since, and salary of over £25,600, permanent position
- I have taken holidays outside the UK using my annual leaves, so no more than 180 days a year
- no adverse record regarding convictions/penalty (apart from one CCJ 10 years ago)
- no recourse to public funds

Documents:

- all passports/resident permits
- Life in the UK (passed)
- Degree certificates for both me and my husband, for level of English language
- employer letter confirming employment, SOC code, salary at appropriate rate
- employer letter confirming annual leaves
- one month bank statement showing salary payment
- proof of cohabitation for me and my husband (council tax bill for the last 2 years)


My only concerning point was my husband is currently off work. But it looks like there is no financial requirement for dependants, and there is no requirement for certain bank statement balance/saving, so it should be ok isnt it?

Correct. The dependants are subject to separate rules

Hi Zimba,

Could you please elaborate if any rules that we might need to be aware of, from my immigration history/documents. My husband and child (under 16) moved to the UK with me when I was on my PhD, before I got the Work Permit visa, and have been dependants on my visa ever since. We have lived together/travelled together. No adverse records, no use of public funds. He has UK degree certificate and passed LIUK test.

There are two points in the government guidance (https://www.gov.uk/indefinite-leave-to- ... ly-members), that I'm not sure how to show, apart from proof of my salary.
- you have enough income to support yourselves and your dependants
- they will live with you and be supported by you without using public funds

Please advise.

The rules set both the criteria as well as the required documents. That does not mean that to meet every criteria you will be needing to provide a document. You are only asked to provide the required evidence. The caseworkers will look at both the required documents you provided as well as other data they hold (immigration history, data from other government departments, etc) to evaluate eligibility as per rules. You do not need to provide any other extra documents for those two criteria

Would you be able to comment specifically on my case, if we seem to have satisfied the requirement, or anything you advise to look into further?
