Congratulations first of all. I know ur ID and some other guys as I ve been reading this forum since last year. I m not good at giving advice to others so I Just watched n learned from others. I read ur first post in which ur visa expired since aug 2010. Now u got the tier 2 visa on june 2011. Were u in england 10 months long without the visa? If so, wow, u r good. Will it not affect if u apply ILR in the future?

Hi price soft,

out of country application is not a good option i think at the moment. i have submitted tier 2 visa application on 9 th of feb 2011 and it was refused on the ground of maintainance even though i provided bank statment covering £800 for consequtive 90 days. my lawyer thought insted of goin for appeal we can apply for a new COS and submit fresh application, she thought proccesing time will be quicker than appeal. we got a CoS again, i have submitted fresh application last month. this time maintainance was certified in CoS by the sponsor. my visa was again refused on same ground that i dont have balance to claim 10 points for maintainance. my company decided to terminate my visa process. my 1 yr visa strugle ended with bad note.

wish i could have made in country application even though it would have been in out of date application by a couple of weeks.

Same here, sorry to hear about your situation Pokale2600.

I have always been a great advocate of exhausting any avenue you may have to rectify your visa situation in-country before deciding on an out-of-country application.

I should point out though that in my case, I applied as much pressure as possible. My Lawyer, Employer and MP all contributed to my being able to get the visa in the end. Above all, I prayed and I believe my faith helped me through.

Even when I submitted the out-of-time application, I made it very difficult for the caseworker to refuse me. I had met all of the requirements, I made reference to the high court case in december that ruled that the temporary limit was illegal together with a host of other favourable references in the immigration rule and parliamentary debates.

I wish everyone applying the very best. I'm still awaiting my biometrics card, but I believe that should be in the post already and I should be receiving it anytime soon.

Curiously, how long generally from the date your passport is received would you normally receive your biometrics?

Secondly, what date would your visa normally be valid from? The date it was approved or the start date of your employment contract as specified in the CoS?

Any guidance will be appreciated.
