So I have one question, say that you are granted a work pemrmit because you are waiting for the EU1, once denied can you just continue with the work permit until the situation is sorted?
i called the DETE and the girls than answer the phone was worst than thoe DoJ, only yes and no answers...excellent so I really miss many points...hope you can make itclear for me thx

yes, you can continue with your work permit if you wish to even though your application for eu1 was denied but the change would be to pay work permit fees!!! which is €1500.00

Still, I haven't seen anything in writing. Although I like dealing with the Dept of Enterprise much better than the DoJ, the following website about workpermits doesn't state a-ny-thing about spouse of EU-nationals working in Ireland. http://www.entemp.ie/labour/workpermits/

What am I missing here, who has more information on Workpermit for spouse of EU-nationals working in Ireland???
Dutch husband, American wife, applied for a residence card, after 7 months got a Stamp 4 visa for two years. :)

I have heard from the employers that Spousal Work Permit is actually taking up to 2 months to be processed is that true? I mean the girl in DETE told me mine would be fast tracked and will take 2 weeks. Is there any diference between the spousal work permit and that we are asking for? or is it the same :?

I think it's different and.. also it should be faster. I should know soon enough......... I heard from others that they generally take around 2 weeks to get back to you.

Hi Peter,

there are several threads with Informations on the Kumar Case somewhere on here.

The case has been ruled in favour of the DOJ. Probably partly due to Mr. Kumars circumstances (previous illegally staying in the UK and Belgium). AFAIK the case now goes to the supreme court, which is expected to take about 2 years.

According to Solvit the DOJ has recenly issued a few temporary (2 years) Stamp 4 residence cards to people affected. But it is not known yet what the criteria for the Issuing of these temporary cards were.

Unfortunately I can't help you with the residence permit route, as we choose the route to leave Ireland instead. I know that Static got it. She posted about it somehwre on here. You might want to PM her for further Infos.

Cheers,
DSAB

I've found it hidden on the entemp website... they probably just added (ofcourse they won't put new things on the frontpage... I've called them yesterday to answer questions.
appearantly the permit is for 12 months and can't be renewed. i asked for clarification, the answer was "it might get extended". i have no idea why it can't be renewed. asked how long it takes for "fast tracking", the answer was "2-3 weeks".

website how to apply for the workpermit is here:
http://www.entemp.ie/labour/workpermits/marriedtoeu.htm

the form which needs to be used:
http://www.entemp.ie/publications/labou ... itform.pdf

see: http://www.workpermit.com/news/2007_03_ ... delays.htm (old news but nothing was said on DETE website and immigration officers/consulates/embassies all point to use the EU treaty rights which will lead to long waiting for rejection when you didn't live in another EU country before coming to Ireland)

You can apply for the employment permit, it's free anyways... in the meantime send an appeal letter to DoJ and complaint letters about DoJ regarding not complying Directive 2004/38/EC to many organisations who can help
what i can advice is:
- contact SOLVIT
- contact MCRI (will support us), ICI, local politicians (look on , TDs, new Minister for Justice Mr. Brian Lenihan, Members of EU Commission, Members of EU Parlement.
- more... see in the other treats in the forum
