Just wanted your advice on my situation, please. I am on tier4 visa till October 2013. My 10 years will be completed in February 2014. I have my family(wife and three children) as dependents since 2005. I want your advice that if I apply private life visa as my children are living here for than seven years before end of my current leave. And of course it will take many months before ukba will decide my application, and i will complete 10 years during that application. Would it possible to apply for ILR during that application? Please.
@r4rashed,r4rashed wrote:Thank you Spidery_thread. I entered on student visa in February 2004 and remained student since then. My two children and wife joined me in Jan 2005. My third child was born in April 2006. They all been my dependents and kept getting visa extensions along with mine and all my leave to remain applications were applied in time. Been out of uk three time. Every time for maximum 6 weeks.

Thank you very much Spidery_thread for your wise answer. When you say requesting ' bridge the gap', how exactly does it work? Please.Spidery_thread wrote:@r4rashed,r4rashed wrote:Thank you Spidery_thread. I entered on student visa in February 2004 and remained student since then. You have availed max of 8 years being a student. Therefore you cannot apply for further LR on Tier 4.
But there are exceptions for certain Subjects and studying at Post Graduate Level at a a recognized institute.
Please follow this link:

Exercising your right to Private and family life is not an easy route, you'll have a stronger case when your 3rd child born in the UK becomes 7 years of age in April 2013.
You can file FLR(O) at the end of your residency period along with your dependants requesting, 'Bridge the gap between the expiry of you Tier 4 visa and your qualifying period for ILR'.
It will buy you some time anyway, if application process time remains at 6 months.
