Hi

once a person get naturalized and get a new British passport,is it possible to surrender Indian passport to Indian consulate even if its expired or this passport needs to be renewed and then surrendered?

Please share your experiences/advice if any.

I have surrendered my Indian passport along with Spouse's and my child's

Documents attached (All each one per applicant)
1) Form
2) Photo copy of British Passport Photo Page
3) Photo copy of all the pages of Indian Passport
4) Photo copy of Citizenship Certificate
5) Self addressed Envelop with Next day delivery stamps

Did you make a postal application to Hayes or did you make an application in person at Hayes?

Dear all, I appreciate your help for the info. on the following.

We have sent applications for British passports for myself,wife and 3 yr old son. My son recieved his passport and we both are waiting for i.v.
I want to find out some info. about what are the step by step process for the ultimate of OCI? Do i need to apply for indian PP surrender first or apply OCI online.
While i await British passport can i start any application process for surrender of PP or online OCI appl?

Hi Suji,

I have enquired previously about this very same question. The answer is No. Self attested photocopy of the current British / Foreign Passport (Only the photo page) is necessary to surrender Indian passport. Hence it can only be done once you have received your British Passport.

Surrender certificate is required for applying for OCI.

Hence all steps have to be done one after another, nothing in parallel. First get British passport, then surrender Indian passport and get Surrender Certificate and then apply for OCI.

I am no expert and I am only saying this from the information I have been reading up and enquiring.

You definitely shouldn't renew Indian passport after acquiring foreign nationality. The date on the naturalisation certificate is considered to be the date you acquired foreign nationality.

The Indian Citizenship Act, 1955, does not allow dual citizenship. Holding Indian passport/acquiring Indian passport/travelling on Indian passport after acquisition of foreign citizenship constitutes an offence under the Indian Passport Act, 1967, and attracts penalties. The Government of India has prescribed imposition of penalty on a graded scale for the violation of Passport Rules, depending on number of trips made on Indian passport after acquiring foreign nationality (with a three month grace period from the date of acquiring foreign nationality i.e. the date of Naturalisation certificate), renewal of Indian passport after acquiring foreign nationality and retention of Indian Passport for more than 3 years after acquiring of foreign nationality. The date on the Naturalisation Certificate will be treated as date of acquiring foreign nationality and hence, it is mandatory for the applicants to produce his / her Naturalisation Certificate for obtaining Surrender Certificate.

Hi I went in person, reached there at 8AM they opened the doors at 8:15 first person called at 8:30, Not much crowded.

Its bit hard to find the VFS office, its inside the Gates with Fiat showroom board (you can park for 2hr in Quality foods)

I hope I am posting this query in the correct thread.
I would like to know if we incur any penalty when surrendering our
indian passport.

Letter received for approval of british citizenship dated as 10/1/14
Attended Citizenship ceremony and obtained british citizenship- 25/3/14
Naturalisation certificate for myself and husband dated as 25/3/14
Registration certificate for daughter dated as 9/1/14

We had to travel to India on an emergency on 2/4/14 (father underwent
surgery), and we decided to use our indian passport to travel, as we
could use for 3 months after obtaining british citizenship. We also
did not have enough time to apply for british passport and indian
visa.

My question is:
1)we became british citizen on 25/3/15. We used our indian passport
for travel to India on 2/4/14, which is within 3 months, so we should
not be penalised.
2)But my daughter's registration certificate is dated as 9/1/14,
though we attended citizenship ceremony only on 25/3/14. We also had
to renew her indian passport on 20/2/14 as we had to travel on 2/4/14.
Now, will that incur penalty?
3) could I ask uk home office if they would change my daughter's registration certificate to the date we attended the ceremony?

Your advice will be much appreciated.

I don't understand why they need photocopy of british passport! Would it not satisfy them to see the naturalisation certificate to convince them? People may take up citizenship, but not bother having a passport if they have no immediate travel plans. Another thing I don't understand is why they need photocopies of every single page of the indian passport, when we send them the original anyway!

What is the maximum time limit to surrender Indian passport after acquiring Foreign passport?

Hi Call2Bala,

It's 3 years from the date on naturalisation certificate and not date of issue on the passport.

However you would need to do it sooner if you need an Indian tourist visa, PIO / OCI as the surrender certificate is a mandatory document required.

Hi Call2Bala,

There is a three month grace period from the date on the naturalisation certificate where you're allowed to travel using Indian passport. Bear in mind that you have to return to the UK within 3 months as well.

Does your baby have visa for UK? If not using Indian passport may not be possible as he/she won't have a UK visa to show with Indian passport during Emigration in India on your return. You can't show British passport that time as it has to be same passport using which you entered. However I'm not sure of this information. I'm in exactly the same situation and from reading around on the forum this is what I understood. I decided to be safe than sorry and I'm cancelled my travel plans until all my daughter's paperwork was in order.

That's a very good point about not having passport - its perhaps just their illogical way of working.

Asking for photocopies is a sickness that all govt offices in India share, VFS are doing the same (on behalf of mighty HCI)

VFS global are a bunch of idiots. They have sent somebody else's cancelled passport and surrender certificate to me in the prepaid envelope I had sent them! Can't they even read names properly! It is not as if the names are similar in anyway- the name of the person's documents I received does not even remotely sound like mine! I spoke to them- the lady while apologetic, didn't seem to realise the gravity of the situation. Asked me to return the wrong documents to them and they will locate mine (which they probably sent to the wrong person) and send it to me. They will, of course, pay the postal charges!

Joe Thomas- if you are on this forum and received my documents , please reply to this- I am Sandeep and you probably have my documents and I have yours!

Oh my god! that's serious... I was thinking I will ask them to send my surrendered passport / certificate by post but seems it will be better collecting it in person!! :roll:

I have acquired British nationality while being in the UK. I will now be going to Spain. Is it possible for me to surrender the Indian passport and obtain the surrender certificate while in Spain? ..and then apply for OCI while in Spain? I seem to find no information on the Indian Embassy's website in Spain. Thanks.
