Hi everybody, I'm going to fill form EEA(PR). I'm EU national, I'm in the UK since November 2005, my question is,
do I need to provide prove residency, work history etc. only for the first 5 years from Nov 2005 to Nov 2010, or I need to provide prove all years since Nov 2005 ?

Hi zsozso1969,
You only need to send proof of exercising treaty rights for any continuous period of 5 years within the time span of 2000-2015. You need to be sure that during the selected 5 year period, you have no extended absences and insurance if necessary ( if you were a student/self-employed/not working). Thank you for your reply. I think I send proof the period of Sept 2007 to Sept 2012, this period the easiest to proof due to same employer and address.
In the application form do I need to list my employments and addresses before and after the selected period?
For proofing my employment do I need to send all of my payslips for the 5 years period (this will be 260 payslips + copies of them )? Or just enough send the P60 forms?

Hi zsozso1969, I think you would need to proof your current situation too. Otherwise how can HO be sure that you are currently in the country and exercising treaty rights? If you only provide documents covering from 2007 to 2012 period I think HO would require additional documents regarding your current situation in the UK from 2012 until now...You do not need to send all of your payslips. My wife was in a similar situation and she send 5 X P60s and 3-4 payslips for each year (she has been living in the UK since 2008 and she has provided documents covering 2010 to 2015 period).

Hi Forza_RC, Thanks for your reply, Are you sure about what you saying or just you think about it?
If you see the form EEA (PR) page 107,
"You must show that you and your sponsor (if applicable) have been living in the UK for the relevant period. If you’re applying on the basis of 5 years’ continuous residence, the evidence must cover the 5-year period."
So the question is, why should I provide more proof over the 5 years period? I'm a little bit confused about this.
Please let me know what do you think about it.

I believe Forza_RC probably meant this because once you acquire PR status, you can lose it if you spend 2 years outside the UK. So to ensure that this was not the case, maybe its best to send some of the more recent documents (P60/work contract). Although I am not sure about the exact need for this. Best check with the UKVI or a lawyer. If you're in doubt, why not use the most recent years? My partner used his time up to Jan 2014-he did not send any documents beyond this period-although his job is permanent.

I'm self employed (limited company contractor) since Sept 2013, that's why easier proof my work history before that date.

Over this time changed a number of employers but did not have gaps longer that 30days between jobs, 3 times went on Maternity Leave whilst remaining employed and returning to work. 2 of my children are British based on my PR status, never thought there was a need to apply for PR certificate but with the way politics is developing now I thought I it's time.

Sent evidence of residence and work history for last 9 years.

I had only experience with Passport Office when I was applying form my children's British passports based on my PR (no PR certificate). I only sent them evidence of Treaty Rights for 5 years prior to their birth, but not from the entire period and was requested to send more as I am A8 national and they wanted to see my WRS. So in my case they were satisfied only after they saw evidence for 5 years since I started exercising Treaty Rights.

Hi buktais, thanks for sharing your situation with us. Your case sounds pretty straightforward. So I think you might receive your PR within 2 months - this is based on the other EU citizens' timelines (who were in a similar situation as you are)

Thanks Forza_RC , hope you are right although I have my weak points too - i intentionally did not submit benefits section, as a worker I am allowed to claim and I did claim after my children were born. Even had a council flat. I will see if withholding this information have any effect on an outcome or not.

In my case (also A8 national,Hungarian) what the starting time exercising Treaty Rights? The date when I arrived November 2005 (I have got WRS shortly after arrival), or when I got my Registration Certificate February 2006?
So the 5 years starting since November 2005 or February 2006?
I can easily send work history from November 2005 to August 2013, but after that I become Limited Company contractor (self employed) and sending proof for everything about the Ltd, work contract,invoices,VAT, taxes, etc. a bit complicated, not impossible but a major headache , so that's why I really need to know what period of years I definitely need to send.

Without a doubt, your Treaty Rights commencend when you started work in 2005, it's either the date on your job contract of the date of your WRS if you were late to register.

I didn't apply for my registration certificate until 2010, got it in 2011 and it does not dismiss my previous Treaty Rights (since 2006).

Thanks for your help. I emailed my enquiries to several immigration law firms, one of them replied the following;
" You need to show that you have been exercising your treaty rights in the UK for a continuous five year period, you can choose the five year period that you wish to show. "
This is enough confirmation for me, and asian_atheart was right about this in her previous comment.

Hi all, has anyone applied for the PR card with the previous form (before the "Biometric information for non-EEA nationals: form
EEA(PR)" released in early April this year) and requested to submit fingerprints and a digital photograph by the Home Office? I applied just a few days before the new form released using the previous form. I was wondering if there are any applicants in a similar situation and have heard from / required by the HO to submit fingerprints and a digital photograph?

Hi , Can someone please let me know that if my residence card is due to expire on 27th July 2015 , How early can i send my application for EEA(PR) Has anyone sent their application 28 days ahead of the expiri date on Residence card ? I will be applying s an extended family member of an EEA Nationl.Also me and my brother both were granted the residence cards through the appeal to tribunal as an extended family members of an eea national as our sister in law is an eea national.Also do we only need to be in the Uk for last 5 years with not leaving uk for more than 6 months or we have to be living with EEA National at his/her Address since the residence card itself states that work and business activities allowed ,Me and my brother both own our own properties and live separately (not with EEA national) but obviously part of same family as being very close family relation.

Can someone please let me know that If i am getting Tax Credits (working & Childb tax credit) and i am on Eea 2 Residence permit which doesn't say "No recourse to public funds" is it all right or i did something wrong as i only get Child benefit and tax credits but no other satate benefit ,now in the new Application form they ask for these details.Can someone please reply if you know anything regarding this as Residence card doesn't say that i am under immigration control.It says Business and work activities allowed instead.

Im ram, indian married polish national on 2011 Dec. i got few questions on behalf of my wife and myself.
1.she came to UK on april 2010. She got the job on April but didnt start until july due to waiting for CRB,NI no, bank account opening,etc. but her contract signed on 8th April. She went to poland for a month and back on may and worked for cleaning agency from june until july. She has payslips for that work. She left this job on july to join main job. She also received letter from her main employer saying employment confirmed on may but waiting for CRB.Question is..
What box she can choose between april and may .. May be Job seeker but she didnt register as job seeker. We cant skip April to june. Because contract signed on 8th April. Please help us what box to choose.
2. And also her work didnt register as worker when she started. Poland take out of this registration process on march 2011. There is an exemption saying she dont need to register if she worked continuously for 12 months. Yes she did work 3 years with them.
3. I came to UK as student on 2006. Graduated on 2008. Got POst study work from 2008-2010. And HSMP tier 1 from 2010-2012. EEA family permit from 2012-2017. When can i apply permanent resident? We married on 2011 Dec. but i worked and lived in UK through 2006.
4. She is preparing her PR application. Can i send mine with her?
There is a paragraph saying i dont need to fill any form if i send my biometric and fees with an explaination letter along with her application.
Please help me.. Any official in town double checking these forms?

Hi kerr b , I called them more than 5 times atleast to talk to different advisors and all of them told me to apply no more than 28 days before my Residence Permit Expires , Also Can you plz confirm what documents did u send to prove last 5 years residence in the UK as i called them to ask and 3 different advisors told me 3 different answers .one said i can send 1 payslip every 6 months second said i have to send 3 payslips every 6 months and also that if i send p60 then i can only send 1 for each year,Also What about bank statements and i dont know if you know but if i am getting working tax credit and child tax credit and child benefit will that affect my application as i am not claiming any other benefits like housing or council or anything like that but as residence permit doesn't say "NO RECOURSE TO PUBLIC FUNDS" i think it should be fine to get atleast tax credit and child benefit .

CAN you please put some light on my case actually im (aged 25) child of eea national currently holding RC which expires oct 2016 . after getting my RC ive been self employed since then and to get my PR i have to financial dependent on my dad dont no how I can prove this for my PR,

For PR shall I applly dependent child 21 or over OR as extended family member (meber of eea house hold ). Because I dont get if I apply as dependent over 21 how can I prove dependency ?

Because in newer PR form it asks about relation to sponsor. Dont understand I choose wich one ,

1 * I am or have been the dependent child or grandchild aged 21 or over, parent, or grandparent
of the sponsor (or of the sponsor’s spouse or civil partner).
Complete section 13.

2 * I’m an extended family member (relative) of the EEA national sponsor, or of their spouse or
civil partner, and I’m dependent on them and/or I’m a member of their household.

If i choose option 1 then I there are questioning about ho much money you recieve from eu national (these type questions )etc ?

have you had an eea family permit for 6 months at start ?

beacuse if you live in uk under eu rules for 5 years then you can apply for PR etc.

OR

you just had 5 year RC and 5 months of it expiring you applied ?
