Hi Guys, I have a very good news. I have received a letter from Immigration and Asylum First-tier Tribunal today. It says my appeal is allowed. What a relief ..uff. I couldn't believe when I heard this news. It also says that The Secretary of State for the Home department have a permission to appeal to the Upper Tribunal on a point of law arising from the First-tier Tribunal's decision which is unlikely to be happen as my solicitor said. I am thankful to all of you guys for your prayers. I don't have words to explain my feelings now. My prayers and best wishes to everyone.

Appeal launched : 21 June 2012 (FAX service)

Docs submitted: 02 August 2012
Decision made : 15 August 2012
Letter issued from Tribunal : 23 August 2012

Congratulations! Im very happy for u horizon your appeal allowed the UKBA. Send me the bundle with letter they write in letter the IAC will contact you distinctly regarding the date time and place of any oral hearing. I already send paper appeal I ask to solicitor he say this the normal procedure if the cort accept paper appeal they send me bundle my passport photo copy visa photo copy bank statement my college letter photo copy and my partner accountant letter photo copy and HMRC registration photo copy and I send all the original document to court the court give me time to send more written evidence if no more evidence no action from you.They not give me the date of hearing they just say like this the court contact u if the court call u any time

Thanks horizon for your reply did you receive the court decision letter if yes when you send your court decision letter to home office yes i know the Tribunal judge very lenient towards appellants.i am just waiting 30th august after that date they send me my appeal decision.

the judge wasnt happy with home office decision, they dint work properly on my application and because home office dnt send any representative to the court, so the judge issue me refund

I need an answer to this question with people that has been to appeal...

At the tribunal, what exactly is the judge looking for in a marriage of convenience case?
Is it the past immigration history or if both couples are married and in a relationship and living together?

If the couple are found that they are married and living together in a genuine relationship under the same roof, is the case solved or the past immigration history will still be looked into?

I am confused here because I don’t really know what the judge at the tribunal are really looking for in a case as HO always use past immigration history to back their decision for refusal without interviewing the applicant or home visit.

A friend of mine that has been living together for almost three years was at the tribunal, she said after they interview she and her spouse, the HOPO accepted that they are in a relationship and they are living together but said they only get into relationship because her spouse past immigration application was refused that is why they got married and the HOPO even say their relationship flourish when her spouse application was refused and the judge question the HOPO if anything is wrong if a relationship flourished.

My friend is really worried if her spouse application will be refused on the past immigration history even though they are genuinely married and living together for almost three years. The spouse has no criminal background but past immigration application was only refused. This is the reason I am asking what exactly will the judge at the tribunal judge the case on.

Received my EEA partners ID back on 18th May
RC refused on 22nd Aug
Notice of refusal with all docs except passport received: 24th Aug
Refusal reasons: no enough evidence showing my EEA sponsor is exercising treaty rights as she is unemployed. I've sent them application on the basis of job seeker and to support that I've attached her job application letters, job centre plus letters showing that she has registered unemployed. But they say in refusal letter that for exercising treaty rights she must be employed atleast 1 year before getting unemployed. Furthermore at the time of decision, she was still unemployed for more than 6 months. So they refuse my case with a right to appeal. If not I have to leave UK.
I want to ask for your help guys, is there any way that I can prove that after submitting my application she started to work since March to prove that she is now exercising treaty rights after application was made? Will that work? If so, what should I do next? Please help guys!

Yes dear I received the court decision letter on the same day as my solicitor received. One copy of the letter has also sent to the home office. Yes dear the tribunal took decision very quickly. I am very thankful to them and Yes my prayers are for you. Be patience i know this time is hard but you will get your reward very soon. thanks for your wishes dear.

If the EEA national is now working, apply again providing evidence of her employment as detailed on the application form.

Dear dont worry you will also hear good news in few days. As you have seen that i got my decision after 10 days of my deadline so hopefully you will received within 2 weeks. But maximum time is 4 weeks for the paper appeal to be decided.

Did you received court's decision in writing? If yes, when did you received that?

When was the court fee refunded? I mean how many days after you received the court's decision?

Can you please share the email address of Home Office from which you received the dispatch email?

Send an email to EREC@homeoffice.gsi.gov.uk

saying your appeal was successful and you want your RC issued immediately, if you won the appeal you could try and push to say that your case was mishandled and by law they need to give you priority treatment.


I did not get my appeal fee refunded no, I was told I was not except from fees as I was not giving removal instructions even though I was asked to make plans to leave the country
