10 years long residence applications

Finally got my ILR. My case was straightforward. Been here on 2 years working holiday, 3 years student, 2 years post study visa, 3 years work permit.

Paperwork Send:
P60 - 10 for each year
Passports
Employee letter (current and previous)
3 months payslip & Bank Statements
Life in the UK test

My time line is:

APPLICATION SEND - 13/07/2013
BIOMETRIC DONE - 5/08/2013
indefinite approval letter - 14/11/13
Passport & Documents - 16/11/13
BRP- Still waiting

Guys can any one please suggest ,
My situtation
I varied my application to 10 year set LR on 12/11/13 from tier2 application
But very next day after varying i received my approval of my tier 2 application and received my documents back from tier 2 departmet as well.
Fee for set lr taken and yesterday i have received the acknowledgement letter from ilr departments as well
Question is
1: should i send my passport and supporting documents to ilr department or should i wait Cw to requet it first
2: if i should send my documents/ passport to home office which address should i send it to , durham or liver pool as this is the address they mention on acknowledgement letter or lunar house london
3: i am leaving my job on which i got my tier 2 visa end of this month, is that mean my tier 2 and my wife tier 2 status will be invalid after i left? Should i apply for flrm for my wife or should i wait for the outcome on my ilr application ( more likely 6 month wait)
If u suggest i should wait for my ilr outcome before applying my wifes's flrm will her status be legal after i left my job and the time she spent waiting for the result of ilr?
Guys plz suggest me i m trying to do all without any solicitor as this forum have been so helpful and my only hope to get guidance is through this forum , hope u can understand how delicate this scenario is for me

By the special grace of God Almighty maker of heaven and earth, my ILR BRP arrived today finally! I guess my passport and supporting documents will soon be delivered. Can someone please update this on skydrive.

I was very worried that I'll be rejected because there was a time my tier 4 extension application was sent back to me because I sent passport photos that didn't match the requirements. But God took control!

Docs I sent were:
Tier 2 BRP
Passports
Life in the uk
Bank statements
Degree certificates
Letters from landlords
Personal statement

Yes, you can send it to them and also wite a covering letter on what happened and do mention, now that your Tier 2 has been processed you want to go ahead with the SET(LR) Application.

I'd suggest you to wait as there is a chance for your wife to get ILR without having to make FLR(M).

If u suggest i should wait for my ilr outcome before applying my wifes's flrm will her status be legal after i left my job and the time she spent waiting for the result of ilr?

After i left the job do u think my wife's tier 2 dependant visa/status will be automatically become invalid as her visa is obviously based on my job , so in other word if she has to wait 6 month to get result for my ilr application ,
would her time spent waiting consider a legal stay?
Any guidance , feed back will be highly appriciated as i only have 11 days to make my mind up that what im gona do in regards to her stay

A migrant is granted leave as the spouse of a Tier 2 migrant. The Tier 2 migrant’s sponsor loses their licence and the migrant’s leave is curtailed. The migrant’s dependant no longer meets the requirement of 319C(b)(i) which is that their spouse has valid leave to enter or remain as a relevant points-based system migrant. You must consider curtailing their leave.

A Tier 2 migrant resigns from their employment when they have twelve months leave remaining. The migrant has not submitted any further applications, is aged over 18 and has a dependant child aged six in the UK.

In this case, curtailment is not mandatory because an exception, applies due to the presence of the dependant child. Curtailment may still be appropriate, but you must consider discretion when making a decision

I have read through the pages mention in above link, didnt quite get them is my understanding right the safest way would be to apply for her FLR (M) now, in the guidance they mention about using discretion when dependant child is 6, we dont have any children so not sure if they could apply discretion
in her case ,

i changed my address using online service week ago.i received auto reply as well that it will take 72 hour unless-----.how i will know that my address has been changed with them.do i need to follow some other steps, please let me know

I am new to the forum. I have submitted my 10 yrs Long residence application on 20th September 2013 and received acknowledgement on 26th September. I haven't received a biometric letter yet. Please can anyone share your experience if you have or haven't received biometric letter who has submitted more or less in the same timeline. Your response would be much appreciated.

If you cannot stick with your current employer until you get your ILR then yes FLR(M) is the right option. Tailor this template to fit your purpose and then leave your current employer.

Finally after a lot of delay got my Biometrics letter yesterday! I had to call HO on Friday and request a second biometrics letter. The lady told me my letter was sent out on 10th Oct and because it had been over four weeks, I could request another one.

I am going to apply ILR (Long residency 10 years) in next 2 months. I needs your help in my case coz it's not straight forward. Here is the details of my 10 years legal stay in UK.

I got student visa on 22-December-2003 but I enter in UK on 22-January-2004 (First Entry ) and then I keep getting extension on student visa till 31-January-2011. My wife joined me in 2010. I applied another in-time student extension on 12-January-2011 and my application returned to me as an invalid (non-payments) which I received on 04-February-2011 (Friday) after my visa expired. I re-applied next working day on 07-February-2011(Monday) and get my student extension successfully. I moved to PSW after student visa and now I applied Tier 1 (Entrepreneur) visa in-time application since 06-September-2013 which is still under process and I hope it'll remain until I'll apply for ILR.

On 02-March-2013 police stopped me for traffic offence (U-turn not allowed) and I received letter from Magistrate Court for hearing on 09-July-2013. The Judge found me guilty but did not put any points on my licence coz of my solicitor's arguments but fined me £55 which I paid on 12-July-2013.

My questions are:-

1.Eligibility: On what date I'll be eligible to apply ILR application ? Is it on 22-January-2014 or 28 days before. Although my Tier 1 ( entrepreneur) visa application is under process.

2.Form: I know SET(LR) form is for me but which form is for my dependant ? and in which category she apply ?

3.Break: Will my 7 days break (I mentioned it in my last application) effect my ILR application ?

4.Court fine: Will fine from court (I mentioned it in my last application) effect in any way on my ILR application ?

You can apply 28 days before your qualifying period.

Applications received 28 days or less before the required qualifying period is completed

You can grant if an application if it is received 28 days or less before the applicant completes the required qualifying period, provided they meet all the other rules for long residence.

Answer Grant the application as the rules allow for a period of overstaying of 28 days or less.

4.Court fine: Will fine from court (I mentioned it in my last application) effect in any way on my ILR application ?

I started by explaining what application I made, the date I made it on, the date I got the acknowledgement letter on and then explaining that I still haven't received the biometric letter. Could I check when was it posted as I'm worried it has been lost.

I think you should be Okay as FPNs / court issued FPNs are not recorded on a person's "criminal record"

Also follow this thread for better insight.

I was on a similar situation than the OP with 2 speed violations while driving with international driver license.

I went to court and the outcome was that prosecutor dropped the case in one and I got a fine of £60 and 3 penalty points on my license.

I thought I could never get ILR until I found this board, luckily Amber was not part of the forum yet and I listened to people like Sushdmehta. Bottom line is my offense was treated as FPN and never got registered in the PNC as a criminal conviction despite going to court.

If you have the opportunity to seek legal advise, get it. I used legal aid in all my journey (with the exception of my BC application which I know it's straight forward, I will apply in October).

Good luck and don't give up on your dreams.
