Hi,

I would just like to inquire if it is possible for a Tier 4 student visa to convert to Tier 1 PSW dependent visa without returning to the resident country of the person applying? Also, may I please ask about which appropriate form should we use for this application?

Your immediate response would be highly appreciated.

Kind Regards,

Sepoy

It is not possible to make this application from inside the UK.

Thanks for the information you have given. Is there any other way for applying this visa? At the moment, looking at PBS Dependant form and FLR O form.

The PBs Dependant form states this:
Dependants should use this form if they
are:
• currently in the United Kingdom as
the dependant spouse, civil partner,
unmarried or same- partner
or child of a person in another
immigration category who has, or is at
the same time applying for, leave to
remain as a PBS migrant.
• currently in the United Kingdom as
the dependant spouse, civil partner,
unmarried or same- partner or
child of a PBS migrant and seeking to
extend their leave for a further period
within their existing category.

From what I understand here, we could only use this if we where applying at the same time, am I correct?

For FLR O Form, it states:
Dependants of exempt members of HM Forces
Though I don't undrstand what this forms primary purpose.

If you can, please help me find a way or better understand why is it needed for a dependent to go back in their country of residence to change from a Tier 4 Student Visa to a Tier 1 Post Study Work Dependant visa.

Kind Regards,

Sepoy

You can't switch into PBS dependant even when applying at the same time if you don't have existing leave as the dependant of the main applicant in the category from which you are hoping to switch.

Currently in the UK as a dependant means having leave in a dependent category; it does not mean simply being married and dependant, but holding leave in an independent immigration category.
