FLR or ILR for my depandent

Dear all,

I have to apply for ILR next month in person, but I don't have clear information for my wife as she is my dependent.

The reason for her, we got married exactly two years ago and as per home office guideline she should finish or granted visa for 2 years either in u.k. or having visa for 2 years as my dependent.

She not finishing 2 years in u.k. also, her visa as my dependent not for 27months.

Please if anybody can reply for my query. Do I need to apply her visa as SET(M) or anything else?

I am assuming her dependent visa expires at the same time as yours, in which case pretty soon she will be 'out of visa' while you have your ILR. The recommended course of action is to book a second appointment for your wife's visa extension immediately after you get your ILR. Then she can apply for her own ILR as soon as she reaches the required years.

Thanks for the reply,

I have tried to contact PEO for my query for my wife's short visa by 30 days in total of 2 years. But on customer helpline no body replying holding the line around 15 mins. please reply on my question as below.

We have a same case like some of the forum members.

My wife got visa as my Tier -1 Dependent in 3.12.10 but she enter in the u.k. 13.04.11 her visa expires with me 05.11.12.

Basically, her visa short by 1 month in 2 years grant as my dependent.
and her stay of 2 years will finish in April 2013.

Do I apply her visa for ILR with me in my SET(O) appointment or apply FLR(M) in seperate appointment.

Can PEO allow me to apply FLR(M) with my SET(O) appointment.
please reply if you have any answers.

Read Q13 again (link provided above by wpilr_nov12) carefully.

Two separate appointments - one for you, and the other for your spouse.

Thanks for your reply on my previous queries,
Yesterday, I have got my ILR successfully,

I haven't apply dependent visa for my wife. I have asked my case worker about my wife visa. He replied to apply for Tier1,2 & 5 PBS dependent form for further leave to remain. Which has been introduce after 1st Oct 2012.

Its not FLR(M)!! as one of forum member suggested previously to me.

Please clarify which form/visa I have to apply for my wife.

Also, can we appear for different visa category than the appointment booked at PEO?

I mean, we have booked appointment at PEO for FLR(M) now we need Tier1,2 & 5 PBS Dependent category?

Can PEO allow us for Tier1,2 &5 PBS visa application on FLR(M) appointment?

Any reply/clarification will be helpful,

When did your wife enter UK as a PBS dependant?
When is her current leave due to expire?
Is your wife a doctor / dentist?

Hi Sushdmehta,

She enter in u.k. as my dependent,, when I was on my Tier 1 (General) visa.

By education she is doctor but not working as a doctor since enter in the u.k.

her visa will expire on 5 nov 2012.
please advice ASAP so I can make some decision to apply for right category.

Also please respond on my query about PEO appointment. As I have booked FLR(M) as per your previous reply.

But now may be I need appointment for Tier1,2 & 5 PBS dependent.

How you are so confident to apply for FLR(M) for your wife!!!
During my PEO appointment my case worker suggested me to apply for Tier 1,2 & 5 dependent visa for my wife.

I would suggest you double check before you apply!!!, otherwise you loss fees money and time both.

innocentdevil - the OP's wife doesn't need to switch to FLR(M) so please stop ill-advising others based on perceptions / assumptions / what you intend to do. And for that reason, I have had to remove your post for the second time!! And if my memory serves me right, this is the third user that you are giving this "advice" to.

which form is right for extending PBS DEPENDANT in the situation of the sponsor being granted as ILR From PBS Migrant. I notice the immigration rules PART 8 319C for PBS dependant changed on 1 OCT 2012, but can't have found the right form. The 'Tier 1, 2 or 5 PBS Dependant' on UKBA seems doesn't address the changes in rules. No options for depending on the sponsor used to be PBS Migrant and now as ILR. Help please?

I believe UKBA asks the applicant to specify the type of application for which an appointment is being booked for a reason!
No one but UKBA can answer your question for sure. People can only speculate based on their own experience at a given PEO but that wouldn't mean that their experience represents UKBA policy.
So, rather than wasting time looking for answer here on the forum it will be in your best interest that you ask UKBA to answer this question - before it is too late.
