Hi every one
I am on tier 1 general visa , We have new baby born three weeks ago just last week I manage to get birth certificate. I am wondering about new law of 28 is it applicable to new born baby as well?
I am going to apply ILR on basis of ten year so looking to apply direct passport after getting ILR for my new born daughter.
Please any idea what rule say for 28 days in case of new born and parent on limited leave to remaining.
Your response and advice will be highly appreciate.
Regards
Amjad |

A UK born child is not subject to immigration control unless the child applies for (and is issued) leave to enter / remain. So the new "law of 28" does not apply to a UK born child if the child has no leave (to enter or remain).
Read 276DE.
And, only a British citizen can apply for a British passport. _________________ Life isn't fair, but you can be! |
