Please can anyone help.
I intend applying for ILR soon.
I have only just discovered there is a requirement for applicants to meet SOC code.
I had WP granted for a straight 5 years period in 2007.
The relevant SOC code I can find is 60% more than what I am paid.
My empolyer is willing to increase my salary to meet the SOC code
Is this a reasonable option for me? I have only 2 months left now to make any adjustments but I gather there is a requirement to provide 3 months statement.
Please what should I do?
Thanks

If you have three months to apply for settlement then you should have no problem. You need one payslip (most recent), a corroborating bank statement and a letter from your employer to apply for settlement.

See 134-SD.

Thanks for your prompt reply. But will a sudden 60% increase not constitute a significant change in salary? I refer to Technical Change in Employment
It is also common for case officers to ask for 3 months permit, amongst other documentation, according to people's experience. Will this not be questioned? Thanks

AIUI, a 60% increase in salary in one go requires a new application under the PBS system. It is up to you whether you wish to apply for extension under Tier 2 first and apply for settlement thereafter or try and apply for settlement directly.

IMHO, law takes precedence over other people's experiences.

Read 134(iii) - 134(v) to understand what the "requirements" are and what the law states with regards to the issue at hand.

Thanks so much everyone for your input.
My question then is what constitutes a significant change in salary in terms of percenatge? 10,20 or 30%? Unfortunately as it came new to me I have missed reflecting any increase in salary to meet SOC code in the last 3 months. I can however make changes to meet the last 2 months before applying but still having sleepless nights as to what the outcome will be. Does anyone have similar experience/advice? Please help
