Hi,

Can somebdoy please provide answers in the case of following scenario:

A child(under 1Cool comes to UK as dependant with his father to join their mother who is british citizen. However at the time of ILR the child is over 18 so he had to apply on SET O form.

Q1. Can the child apply for naturalisation with his father after being in the country for three years or does he need to wait five years?
Q2. If there is a time gap between the date of expiry of dependant visa and the date of approval of ILR then does it have any problem on future applications even though it is not applicant fault at all i.e the ilr application was made in time but HO take time to process them.

1. 5 years.
2. If the application was made in time, there is no gap as the previous immigration status continues until a decision is made.
