Need Urgent Help- Visa for 66 years mother of HSMP visa hold

Post by anjalik » Wed Jul 14, 2004 3:23 pm

I am in UK on a HSMP visa for the last two months. I am now planning to bring my family and also my mother here to live with me.
She is 66 years of age, alone and lives with my family back home.
I am the only child and do not have any relatives.
She also does not have any close relatives.
I have a good job here and am staying in my own rented accomodation
Does my mother qualify for a visa to live with me?
Will there be any issues?
How do I proceed with getting a visa for her?

The rules would clearly allow her to come (provided you can support and accomodate) if you had ILR already. However, I do think they could make a discretionary decision if you show enough means for all of the family. The fact that you are so recently in the country may be an obstacle, though, as it's more difficult for the government to know your prospects.

I am moving to a 3 bed house soon and have a job that pays well.
Would you advice me to wait for some time ? What would be my chances if I apply now?
Does my being a HSMP candidate help me?
If they reject the application, does it create any problem for my mother to come here on a visit visa?

According to the informaiton you provided.I guess u dont have ILR.And u recently entered to UK.If that is the case then i dont think u will have any problem for bringing u'r wife, children if you provide all the evidence i.e pay slips, bank statements, employers letter. But for your mother i think it is difficult.

She may come on a visit visa for 6 months that too is difficult if you are planning to sponser them because u have to show 6 months payslips/bank statements which may be difficult for u right now.

But bring u'r mother permanently may not be possible. This is what i feel.

Moderators can help u better.

Good Luck.

Anjalik,

It is possible to bring your mother and this 'subject' was covered at the begining of this year - I advise that you search for posts by a user called 'Dip' as he has his mother as a depedant with hiom in the UK - the only difference is that he has ILR , however your circumstances are the same...

...if you cant find the post then try to send a pm to Dip and Kayalami

Click on a 'users' profile and then click send Personal Message (PM) - Is there any thing else that you would like me to do??? :(

Anjalik,

This is a follow up post pursuant to your pm. The admission of your mother in the UK as a dependent would be dealt with outside the immigration rules because you are not settled in the UK i.e. you do not have Indefinite Leave To Remain or British Citizenship.

IMHO the chances of a successful application for your mother to be included/come as a dependent to the UK with your wife and kids is low to non existent as things stand i.e.

1. You are on year 1 of HSMP - this may or may not be renewed.

2. You are working on a contract basis.

3. You have only recently entered the UK - consequently you are unlikely to have any significant savings to demonstrate the required level of support for two adults and 2 children.

Wait until you have the 3 year HSMP extension then apply for her to come to the UK - you need to put forward the compassionate grounds the application should consider. You primarily have to show that your mother has no other relative she can turn to - this must be out of circumstances rather than choice and thus the bruden of proof is solely with you.

An application to enter the UK as a visitor would be considered under the immigration rules with a focus on returnability after the visit. IMHO it would be easier for your mother to get a visitors visa while your wife and kids are still abroad.

Note that as always this is just my opinion. You may wish to seek further legal advice on the matter. Any person providing such advice must authorised by the Office of The Immigration Services Commissioner unless otherwise exempt e.g. lawyers.

Hope that helps
