Sponsoring family visitor with pending ILR

Post by cjlk2002 » Mon Jun 03, 2013 7:43 pm

Hi All,
Just need some help with a Family visitor Visa my in laws are planning to apply. Here is the case.

I and my wife have applied for ILR (SET (o) ) in february and we are still waiting for a decision. My local MP is dealing with the home office on my behalf now.

My wife is pregnant and we are expecting a baby in 4- 5 weeks time.

My in-laws are retired, but own a couple of properties and have a steady income from renting them.

We would like them to be here to during this time as this is our first baby.

I have a good income around £40k and own a 3 bed property. I sponsored my parent a couple of year ago in the same category and they were granted the visa.

My questions are :

1) Can I sponsor my in-laws now or do I have to wait for my ILR?

2) As I do not have my ILR yet what are the chances of my in-laws getting a family visitor visa if I sponsor them.

3) What are my options?

Thanks you in advance.

AFAIK you cannot invite under family visa as you are not settled, so they have to apply under general visit visa
2) As I do not have my ILR yet what are the chances of my in-laws getting a family visitor visa if I sponsor them.
if they show strong ties with their home country, there are more chances of getting visa
3) What are my options?

Thanks for the reply. My question is as I do not have my passport or my visa was expired in march (I applied for ILR in feb) can I sponsor them?

The documents we need will depend on the circumstances of the case. We might need your visitor to provide:

evidence of your immigration status in the UK; and
a letter of sponsorship explaining your relationship to the visitor, the purpose of their visit and where they will stay during their visit.

Should I just send all the other documents and not mention about the passport or ILR?

just provide ref number of your pending ILR application on your sponsorship covering letter and for added peace for you, attach the acknowledge letter.

I did the same and parents got the visa.

Thats great news. Did you send a cover letter explaining the situation? What are the documents did you send them?

I sent copies of

1) passports
2)BRP card which was due to expire in 14 days
3)ILR application ref number ( I didn't attach the acknowledgement letter)
4)Invitation letter explaining pregnancy situation

No employee letter, no tenancy agreement, no payslips, and no other letters.

along with the above letters Parents used their own

1)bank statements
2)property documents
3) general visit visa application form

the 4th day they got visa, normal procedure no fast track.

I see so when you applied for the visit visa you had 14 days left on your visa? Mine expired in february. Do you think it will be an issue.
