Remain in the UK with family

Post by KPD81 » Wed Jul 30, 2014 1:58 pm

Hi,

Can I just double check if my wife can apply for a FLR(M) if she is in the UK on a family visitor visa.

Married 4 years, I am British national.

From what I understand According to this https://www.gov.uk/remain-in-uk-family she can.

Many thanks!

It's not possible to switch from a visitor to any other category of visa from within the UK. She will have to return to her home country and apply for a spouse entry visa from there. Do you currently earn at least £18,600 per annum or have substantial savings?
Within your link under 'eligibility' the following passage applies:
You can apply to extend or switch in any of these routes if you’re eligible, except if you have permission to be in the UK:
as a visitor

for less than 6 months – unless you got your visa to get married or become civil partners or you got your visa to wait for the outcome of a family court or divorce
on temporary admission or release (you don’t have a visa) – unless you apply in a 10-year route
(Casa, not CR001)
Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
