ILR rejecated and fee refunded... need your advise asap

Dear All

my husband ILR application rejected and fee refunded. need your value advised.

history: applied for entrepreneur depended visa and been refused and appeal against decision and it loss on 6th October 2015.

he finish his 10 years legally on December 2014.

apply ILR application 15 October 2015 and it rejected saying
section 3C immigration act 1971
"A person may not make an application for variation of his leave to enter or remain in the United Kingdom while that leave is extended by virtue of this section"

can he reply for ILR application or does he overstay?

wait for reply asap?
