Urgent - Adequate Maintenance UK Spouse Visa

Post by Kalu-UK » Wed Mar 02, 2016 7:01 pm

Hello, I need help with my wife's spouse visa, I've a wife in Morocco that I married about 6 months now whom I met a year and half now whilst she was a student in UK.
I currently have a full-time job which doesn't meet the financial requirements of £18600. My parents are quite sick so I'm planning to do carer's allowance as I need to take care of both of them.
I don't know much about the adequate maintenance requirements, but the carer's allowance would be about £62 per week. If I work part-time would I not be able to get on with the adequate maintenance, if not is £62 enough to get on with it then? , if not Is there anything I could do to make it possible.

By the way, I live with my parents whom they are happy to welcome my wife to live with us as well, so we have free accomodation ( free rent ). :D

Please advise me further, I don't want to lose any hope on getting my wife here. As My parents need me, and I'm just not able to move there either. :(

Applying under adequate maintenance requires you to have £144.00 remaining after paying rent or mortgage and Council tax...although it appears that you are living rent-free with your parents. This maintenance level may increase in April.

£144 per month? As we don't pay rent or mortgage or council tax then 62*4= £248 would be left.

If I work part-time whilst being on the carer's allowance, can we still apply for visa it being as an adequate maintenance?

Yes, but you must also submit the following evidence:
(a) Official documentation from the Department for Work and Pensions or Veterans Agency confirming the current entitlement and the amount currently received.
(b) At least one personal bank statement in the 12-month period prior to the date of application, showing payment of the benefit or allowance to which the person is currently entitled into their account

Sorry again, in this post it says this:

Key rates 2015/16 are:

Income support rates for a:

couple: £114.85 per week/£497.68 per calendar month

single person under 25: £57.90 per week/£250.90 per calendar month

single person over 25: £73.10 per week/£316.77 per calendar month

each dependent child: £66.90 per week/£289.90 per calendar month

income support family premium: £17.45 per week/£75.62 per calendar month

Does that mean couple is 114.85? if not please attach where I can find more information about the £144 per week thank you very much!

With apologies, my error. The income support rate is £114.85 weekly for a couple and it appears no increase in April .

No problem, So if I earned £60 part-time per week + £62 carer's allowance I'd have £122 that would be enough to apply for the visa with hopefully?

It would appear so, but note:
At least one personal bank statement in the 12-month period prior to the date of application, showing payment of the benefit or allowance to which the person is currently entitled into their account

Does that mean I need to work for 12 months or I could give them about 6 months worth of recent payslips including the carer's allowance?

Thank you so much, you've been a great help for us to understand more. one more question does that mean I need to work for the whole 12 months period or we could provide them about 6 months worth of recent payslips including the carer's allowance?

The wording is slightly ambiguous...but I believe 6 months of payslips + bank statements showing receipt of the Carer's Allowance would qualify.

Thank you so much, I would have thought so, as well, as they said At least one personal bank statement in the 12-month period prior to the date of application, and not 12 months worth of bank statements. :|

Reading the "Immigration Directorate Instruction ... Adequate Maintenance and Accommodation (August 2015) document.

With respect to the spouse visa. There are calculations inside of how much income the sponsor must have to meet these requirements.

However, would someone who depends for his Financial Requirement (appendix 2) wholly on cash savings (£62,500) not have to worry about the passages in this document on his ability to maintain and accommodate his spouse? In other words, would the UKVI automatically assumed that someone with cash savings of over £62,500 would be able to meet the maintenance and accommodation requirements stated in this document?

But should the UK sponsor perhaps in a covering letter with the visa supporting documents explain this, in case the ECOs don't spot it themselves?

Your wife isn't applying as the spouse of someone claiming carer's allowance under the 'adequate maintenance' category. Don't further over-complicate your application, this doesn't apply to you.

And please don't tag questions about your spouse visa application onto other members topics, it is not fair to the original poster. You have many topics on your spouse visa application, pick one and please continue your questions in one of them.

Also, as we married in Morocco and of course we have translated our marriage certificate, that should be recognised in the application for spouse visa? We wouldn't need to apply for fiance visa to marry here in UK...? :|

If you're legally married through the Court in Morocco, your marriage will be recognised under British law.

Hello again, I have another question.

I have been looking at housing inspection specifications and I'm confused.

http://www.tameside.gov.uk/housing/inspections/ukentry
Here it tells me the measurements are for the "floor space" of the room, is it with or without furniture?

Locked
