ILR (Set O) for spouse on Tier 1(Dependant) Visa - Financial requirement

Post by yogeshvaman » Fri Jun 12, 2020 3:54 pm

Hi Moderators,
I am on ILR (granted in 2014) and my wife is on a Tier 1 (Dependent) visa (renewed in 2017). She has now completed her 5 years of stay in the UK and is now applying for ILR. We are using the online form Set(O) to make her application.

In the finance section, I only see the question on Public Funds, but nothing specific on minimum funds for subsistence etc. My understanding was that there is no financial requirement for spouses on Tier 1 Dependent Visa applying for ILR using Set(O).

However, I am reading in various places of a requirement to have £16k / 18k of cash funds to qualify. Please could someone help - i would be hugely grateful. Her visa expires on 28 June so we have to make an application soon.

Thanks v much in advance for all your help.

There is NO financial or maintenance fund requirement for ILR.

It applies to a completely different visa category. Different visas have different requirements.

ILR for spouse on Tier 1(Dependant) Visa - Public Funds

Post by yogeshvaman » Mon Jun 15, 2020 11:45 am

Hello moderators,
I am already on ILR since 2014 and my wife is applying for an ILR - she is currently on Tier 1 Dependant Visa.
We are using Set (O) online application form.
In the finances section, there is a question on Public Funds. My wife has not claimed any public funds but I have claimed the following. (We have a 4 year old son who is a UK passport holder - the benefits were claimed for him)
1. Child benefit (stopped claiming in July 2018) due to high income threshold
2. Tax Free Childcare
3. 30 hours free childcare.

On the application form, i can only see Child Benefit, but not the other 2 benefits on the list. How should we respond to this question? The list includes the following:
--------------------------------
FAMILY HELP
child benefit
child tax credit

INCOME HELP
income-based jobseeker’s allowance
income related Employment and Support Allowance
income support
a social fund payment
state pension credit
working tax credit
universal credit

CARE AND DISABILITY HELP
attendance allowance
carer’s allowance
disability living allowance
personal independence payment
severe disablement allowance

HOUSING HELP
council tax benefit
council tax reduction
housing benefit
housing or homelessness assistance

-----------------------------
1) For child benefit, I have a letter confirming the benefit has been stopped and the weekly amount we were eligible for.
2) For Tax free childcare, I have statements from the online account showing the top up amounts credited to the childcare account over the last year
3) for 30 hours free childcare, I have an email from my childminder setting out the funding amounts she received from the council towards childcare costs over the last year.

Do we still need to submit information on 2 and 3 funds - if so how do we indicate this on the form? Would the above be sufficient?

I would be very grateful for any advise and guidance. Thanks in advance for your help!
Kind regards,
Yogesh

You don't need to declare any of this, as you are not part of the application.

Hi Rambo_ILR,
Thanks v much for your reply. really appreciate it :)

The question on the form is:
Do you or anyone else who is part of this application receive any public funds?
Guidance text below the question is
'Include details for your partner or child if you have one. Examples of public funds include Income Support, Child Benefit, Housing Benefit, Council Tax Benefit, Carer’s Allowance and Disability Living Allowance. See a full list.'

The guidance text is asking for details of benefits claimed by the partner. That is what is confusing me. :?

Are you saying that because I am not part of this application, the answer to this question should be No.
Please could one of the moderators confirm as well.
Thanks v much!
Yogesh

ILR (Set O) for spouse on Tier 1(Dependant) Visa - Evidence of immigration status

Post by yogeshvaman » Thu Jun 18, 2020 11:08 am

Hi All,
My wife is applying for ILR using Set (O)- she is on Tier1 Dependent and I am on ILR since 2014.
There is a checkbox asking for 'Evidence of Mrs ********'s immigration status in the UK' .
Can anyone advise on what evidence we need to submit to prove her immigration status?
We are providing the following:
1. Bank statements and payslips for both of us showing same address (last 12 months)
2. Utility bills for both of us, including one in joint names (12 months)
3. Child's birth certificate and passport (born in UK)
4. Passports and BRP for both of us (There is a seperate checkbox for submitting her BRP)

Are we missing anything?

Thanks in advance for your help!
