Switch to parent visa

Hi,

I am a parent of a 7 child who is British. She was born here and I lived here for 10 years on a spouse visa before our relationship was strained and travelled back to India with my daughter. I then had a break of 2 years and came back on a work visa with my daughter. My husband had filed a case to get my daughter back in the country (c66). I weighed out a lot of things and came back to ensure stability for my daughter. We are however, separated and my daughter lives with me. I have applied to the court for a child arrangement order in place to avoid any conflicts down the route. Our divorce, however, hasn't been filed yet. I was thinking of switching to the parent visa given how immigration rules are changing and I'm case work doesn't extend visa or can't later down the line.

Please could you advise , in this case, how I would apply for visa given that my divorce hasn't been finalised? What documents will I need. The c100 application is in process, so will have something regarding my daughter's care. Are there chances that I wont succeed with the application?
