Marriage Visa without Docs? URGENT

I applied for ILR in person last Wednesday on 5 year WP status. They put the case though to a "refusal officer" and said my chances of success were very slim as I violated the 90 day rule. While the case is being reviewed they are holding on to my passports and docs but said they would send their answer back by this Wednesday. I have still not received anything and my WP is expiring on Monday 2nd March!

My understanding is that if I do not receive a reply before 2nd March I will not be able to submit a new application for further leave to remain under a different category.

Question: Can I submit a new application for further leave to remain on a Marriage Visa ( I married this January) now without the passport and documents and enclose a covering letter stating the docs are in another department in the Home Office? Are they likely to accept the application??

If you quote your Home Office Reference number, refer to the application currently with them and state that supporting documentation is with that application, they should link the new application to your file and it will be dealt with in due course.
