Trying to get an idea about hearing day.......

Post by heman » Tue Mar 31, 2009 3:13 am

does anyone from this forum, had a hearing very recently?
I found out so many users including me from this forum, ask question about hearing day, we dont have any idea about it and some of us dont have lawyers or money to hire them. So please can u share some experiences so that we can learn how to prepare ourselves now. please please even a single information can help us a lot.

After my hearing day I will post here every thing so that if anyone faces the same problem, will get a clear idea what exactly he/she should do
Cheers!!

After submitting an appel to AIT it takes few days (1 week or so) to get a letter from AIT that they have received your appeal papers and in return they will inform you the appeal date which is about 4 weeks from the date you get the AIT confirmation letter. You will have to then prepare your bundle and send one to AIT and one to HO Rep Unit. Once you had your hearing it takes another 2 weeks for the judge to send determination to both parties. Then if the appeal is allowed HO will have 5 days to put an application for the re-consideration and if the appeal is dismissed then you will have 5 days to submit papers for re-considertaion based on the fact that Judge made an "error in law". I hope that answers your question.

On the day of hearing your case might be the first or very last so keep your lunch with you just in case. In the court room, HO Rep will have a first go to create some grounds that why you shouldn't be in this country and the judge will listen to it and make some notes. All the time the HO rep can ask you question at anytime, the judge can interept both (your lawyer or HO Rep) and can ask you questions. Then it will be your go or your lawyers who will put his caser forward that why the refusal was wrong, he can ask you questions at any time.

Always try and ask your solicitor, the questions which he might ask and prepare an answer for it. Do a question/answer moc practice and try and make HUNCH for questions which the HO Rep can ask you ANY TYPE OF QUESTION (not even related to refusal), but usually to come clean they will only ask your questions related to the refusal, Only judge can ask you questions apart from refusal. Once the appeal is done if its a straight forward appeal the judge might tell you the results straight away if not then i will take from 1 to 2 weeks for the determination to come in the post.

Hope that answers the question.

Great Stuff man. Thats good news. Now the only wait would be to wait for the passport endoursment letter from HO and at the minute its a long one. But if you have a solicitor contact your solicitor and see what they say???

Good Luck
