I am British, currently residing in Spain, I have 2 Children, 1st Born January 2005 and second Born September 2009. My partner (I am un-married) is from Uruguay.
I have had no need to travel back to the until recently, as I require Medical attention that the Spanish Health Authority Can´t Provide.
As I have continued to pay my Social Security Payments in the UK, I am entitled to medical cover on the NHS. However part of my re-habilitation requires me to be with my family. And we plan to move back to the UK in the near future.
I sent a Passport application to the Consulate General in Madrid and this was declined as my Son did not automatically qualify, and was asked to submit an MN1 Form. I was outstanded to find out the Fees associated with submitting this form and the timescales that they work to.
I am wondering if anybody has had these fees waived on compassionate grounds?
I have contacted the Consulate General and the Ambassedor´s office in Madrid, and I have yet to hear anything from them.
Or am I stuck in Spain???????????despite need of medical attention. If anybody could please help with any advice it would be very much appreciated.

No waiver, sorry.
Pay the fee and register the child as British and be done with it. If you choose not to apply, option closes at age 18.
Timescale for processing at the Home Office, about 1-2 months.
Alternatively, marry the mother. Your choice. But in nationality terms, it would actually be simpler to register the child with the Home Office. |

Hi JAJ,
Many thanks for the reply, however like I said I need to return back to the UK on medical grounds with my family!!
I simply cannot afford the fees as any spare monies are being absorbed by Private Medical Care that the Spanish Health Service cannot provide me.
Any other ideas???

Dear All,
One minor thing that I forgot to mention that as I cannot forfill the fees for the MN1 form and my treatment back in the UK will be 26 weeks, is that we have explored every avenue of travel documentation, and wait for it the British Consulate in Malaga have advised me that it would be best that my 4year Old is put into the hands of Social Services here in Spain.
I am very disturbed by this and woul dlike to know your opinions as I would like to fight these F@#ckers as I do believe it is breaching the rights of a child and is Violation of my rights as a British Citizen.
Any comments would be appreciated.

No, choice, sorry. Pay the fee or get married. There is no other way for your child to become British.
I am curious how you can afford to travel, etc, and not be able to afford a registration fee that is a few hundred Euros. Leave your child with social services, where does the other parent fit into all this?
Are you planning to move to the United Kingdom - or just visit? Visitors can't usually use the NHS, as far as I know, and paying National Insurance is nothing to do with the NHS. |

My Parents are prepared to pay for us to get back into the UK, howvever I cannot make arrangements until I have the documentation in place. My GP in the UK has already made a referral to the medical teams in my Local district. My treatment will take a minimum of 26 Weeks, I would obviously like to return back to Spain when I have got the proper treatment.
The other parent is currently my Carer, theirfore it is necessary for her to to travel with me, hence no option other than leave one of my children in a foreign country with an obvious language barrier in the care of Social Services.
Any other help would be appreciated.

You have already been given two ways for your child to become British. There are no other ways to get citizenship for the child.
If you are really living in abject poverty, can't your parents help pay the fee for their grandchild to become British?
Does the child have a Uruguay passport? |

Yes I am looking for more options, unfortunately my parents have been paying for my medical fees in Spain and have no ran out of funds.
My child does not have a Uruguayan Passport

Hi
There are no other options to make child British. MN1 or marriage. Sorry.
Why can't child get a Uruguayan passport?
And is there a reason why you can't get married? |

Many thanks for all your help but I managed to get the MN1 Form submitted with the help of my consulate in Spain, I am waiting for the forms to be snt via Diplomatic Bag some time this week. |

Processing time for MN1 shouldn't be very long, no more than about 2 months, normally. Follow-up if you've not receive the Certificate of Registration in this timescale. It will be sent to the Embassy/Consulate and you can then pick it up (and apply for a British passport).
Is there a reason why the child does not have a Uruguay passport? But then you suggest on another thread that the child is Spanish, or is that another child? |
