HSMP question

Post by fpvt2 » Tue Nov 01, 2005 4:53 pm

I have a question about Highly Skilled Migrant Program (HSMP).
If I apply and get rejected, will I in the future have a problem applying for a NON immigrant visa like Permit Free Training Visa (or even Visit visa) ?

Do you know of a good attorney to help with applying for HSMP ?

Thank you very much.

Another rogerroger situation (also posted under General UK immigration).

Each application is treated on its own merits so I would not think that a rejection of a HSMP application will jeopardise the other visas that you mention.

As regards attorneys, all I would suggest is that as you have got this far, do some more leg work and you will find your answers in this forum.

Thank you.
Does applying for HSMP application mean that you want Indefinite Leave to Remain in the UK ?
Because if it does, and the HSMP application is refused, the next time I apply for NON immigrant visa like Permit Free Training or Visit visa (which means you do not have the intention to stay in the UK permanently) the case officer might give me a problem.

The only thing applying for the HSMP at this point in time means is that you are seeking to work in the UK, nothing more. I have been rejected for an HSMP and i HIGHLY doubt that this would ever effect any potential future endeavors in the UK- be it entry ( I dont require a visa), work as a spouse of an EEA national, studentship, work permit, or if I get an HSMP in the end anyway. Besides, you could decide at the end of 2 years you hate the UK and want to leave- they dont assume that you are going to end up with ILR just because you have an HSMP, frankly sometimes I think they would rather people left and went home before they reached the ILR stage

Also, you are giving the IND FAR more credit than they deserve. They barely got a computer system down in Croydon in the department that handles asylum applications, and your copied application papers are undoubtedly tossed from Sheffield once they finish processing your case. There is no central computer system and little working between divisions. A few asylum seekers have scored work permits, or have received HSMP. Really, just relax about it.

Thank you for your reply.
I posted my message on another forum here before I found this forum.
One person answered that "Application of HSMP is not really a visa application. It becomes one only when you apply for EC on recieving HSMP approval. "

What is EC ?

Thank you.

EC is Entry Clearance, the other half of the equation. Once you get HSMP approval then you take the HSMP document to your local British Consulate or what have you in your country where you fill out the paperwork and hand over your passport to get a stamp in there signifying that you have special work privileges. HSMP approval does NOT necessarily mean that you will get EC- you have to satisfy these people at this stage that you have the necessary funds, etc to move.
