hi all
can any one tell me please because im confuse .can you claim the treaty right of resident as family member of eea after three year been marry before the process
of the divorce or up until the decree abulote.so if i married on January 2008 and my wife get her divorce on January 2011 can i claim my treaty right of resident or not? as she start the divorce on June 2009.i also have or her p60 as she was exercise her right of resident and we lived here in uk for the last 3years .im working as well.

Please have a look through the numerous posts on this topic in this forum. The requirement is three years of marriage. You are not divorced until the decree absolute comes into effect.

The Couple should be Married for 3 years before the divorce proceedings start for anyone to retain rights of residence
