Hi,
Updating on behave of my wife FLR m application

Application date :15 Aug 2012
acknowledgment letter recived: 21 Aug 2012
now waiting.....

she applied as her leave to remain(tier 1 dependent) was expiring on 17 aug 2012. she applied with covring letter saying she will send partner passport/ HO letter once he recieve his ILR granted. i have just recieved my ILR(10 year long residence) on 5 sept 2012 and planing to send my docments so HO can start processing her case. just wonder is this possible to just send HO letter to Them as i am not very confident for send my Biomatric card as if i lost it thats the only thing i have to prove i got ILR?

i hope somebody who gone through in same situation have idea what should i do?

I was wondering would they ask me to leave the country or anything like that? Or could I just reapply from UK?

Badger111 I considered doing that and was told that you must have a valid visa to stay in the UK if you are going to withdraw and apply again. Not sure of your situation but that's what I was told...

Has anyone had any experience with processing their visa quickly based on family emergencies?

I've just now had news about my dad's failing health and he's in the ER. I'm pretty sure I've heard others on here saying they have ill family members but the UKBA has refused to help them out. Not sure my situation is yet serious enough, but my dad's not doing well and if his situation deteriorates quickly, I don't want to be sitting around twiddling my thumbs. Sad

Hi,

You and me have a very similar timeline. I have completed 7 months now and still no update.
you need to call them on 0870 606 7766 and select option 2 which says return of documents. You will be on hold for around 10-30 minutes before your call is answered then you can tell them your name and your case ref no. and they can tell you whether a decision has been made or your application is yet to be decided.

If your previous visa has expired then you cannot reapply from UK and would need to leave the country.

I understand your frustration but the new rules are applied based on the date of application (see below my case) and personally I think they are so bad that you should just wait for your application to be processed.

I applied online on 19 June 2012 before the rules had changed but my appointment was on 3 August so everything I had filled in the online application was scrapped and I had to fill the new application and provide more documentation i.e. contract of employment, letter from my employer, 6 months of bank statements and pay slips, tenancy agreement, proof of address.

Additionally, because my application was dated as of 3 August if my visa is granted it would be under the new rules so it would only be valid for 2.5 years, then I would need to extend for 2.5 more years, then apply for ILR.

I see. Well I got here on fiancée visa, which was issued 23.12. last year, and expired this year in May. I have of course enterde civil partnership in March this year.
Another thing with me is that I'm from Croatia, I do not need visa to visit UK, but I needed visa to enter CP. And Croatia is joining EU next year in July, so whatever rules are now will not affect me after Croatia joins EU because I am a partner of British citizen.
I know it's best to wait....my biggest problem is that I need NHS number because I have some issues with my health, and this waiting is killing me because I can't get any help unless I start dying.
It has been over 6 months since I sent an application...

If her previous visa has expired then she has to leave the country immediately after withdrawing the application and cannot reapply inside UK.

But are you allowed to a file a fresh application when already your old application is in process. I am sure they will say , withdraw your old application and then file for a fresh application.

I am thinking to ask for return of my wife's passport , without withdrawing my wife's application. Will they allow me to do that ? Atleast by doing this, she could atleast register with employment agencies ? Do you have any idea about this ?

Hi Kshah,

Just to let you know, my passport turned up today therefore yours should turn up shortly.

The letter just states that a copy has been retained with the application and I won't need to return it unless a caseworker requires it.

I asked an immigration lawyer about the option of opening another application and they said I would have to withdraw my application so it is not possible once the previous visa has expired.

I called the return documents line (option 2 of UK BA telephone) and asked if I could ask for the return of my passport without withdrawing my application and the lady said that if my passport is returned the application would be withdrawn.

And one cannot file 2 applications concurrently. I am a victim of this as i was getting sponsored from kpmg for employment unfortunately i was not able to apply for work permit while my FLR(M) was pending decision.

It's seems we are stuck in a limbo. UKBA is playing with peoples lives. I know many other people have commented on taking this issue to the newspapers but has anyone actually done anything.. does anyone think raising this to Local MP would help ?

They just can't give dumb answers...i I will write a letter to Metro newspaper highlighting our plight.. hope I see other people also taking some action...

Does anyone know what your status would be while you were waiting for your passport, if you decide to withdraw your application? Especially in regard to working. Would you be able to work until the day your passport is returned or would you have to stop working the day you call up to withdraw?

Also how long (in days) would you have to leave once your passport is returned? a week? a month?

Any help appreciated.

I thought the same, but my friend's partner came here from Taiwan, and he got his appointment in 3 weeks in Liverpool!

My MP's secretary was useless. She just said, "It's a well-known fact that these applications can take over a year." Hmm, great, they don't advertise that on the UKBA website!

Biometrics card received: Waiting
Visa Type :FLR(M) Unmarried Partner
Visa From: PSW
Nationality: Canadian

I went in yesterday to submit my biometrics and both machines in my city were down due to some sort of system upgrade, apparently. They were working today. Fingers crossed for this upgrade to speed up the process!

Also, interestingly I got 2 separate biometric invitation documents in the post, one dated the 4th Sept, one dated the 5th Sept. The documents were identical though one was addressed to a Mr. and one to a Miss. Weird!

I just had a thought about contacting the labour party and notifying them with the major delays. I think that Miliband will be delighted to bring it up when he can.

What does everyone think ?

I am not sure that labour would want to bring the topic of Immigration up in the parliament, even though this is not "Uncontrolled Immigation". He is smart enough not to shoot himself in the foot. COntact Keith Vaz instead I would say.
