Further Ref to CJEU made on Scope of Article 20 TFEU

Post by Obie » Mon Jul 11, 2011 6:33 pm

A court in Austria has made a Reference for Preliminary ruling to the Court of Justice of the European communities, on the scope of Article 20 TFEU, whether or not the rights of residence granted to beneficiaries should be according to EU law or National, and in which circumstances the beneficiaries could be refused rights of residence.

I knew we have not heard the last of McCarthy. Hopefully the courts would get their acts together and clarify things.

Interesting. Sounds similar to case C-83/11
