Second extension

I needed some assistance to figure out the right form to fill up my Tier1 extension. I was covered under HSMP judicial review (got my HSMP under the approval letter in Oct 2006) but currently hold Tier1 and hence was thinking that I should be filling up "flrtier1.doc" form, which is on the link:

that says "Migrants who currently hold HSMP leave and have either applied for an extension of stay or will need to do so in the future".

But when I called UKBA today to confirm, they mentioned that since I have already covered 5 years under the HSMP scheme and currently not holding HSMP, I will have to fill out "t1-general-form.pdf" form on the link:

which is a purely points-based form. Moreover, I will now no longer be covered under HSMP provision as there is no say on what happens after 5 years. This I think will jeopardise my future applications also.

Can anyone of you please through your insights on this?

Advice given is bad in law as well as on facts. Just ignore that. There was no need of calling UKBA when precedents are available on this forum.

Fill FLR Tier 1 (HSMP) and send that.

There are so many examples of getting second extension of HSMP.

Send your HSMP approval letter with above form.

Dear Jami,

Thank you for your clear and concise message. However, since I have been refused ILR (for a reason I was not expecting), I am a bit worried for not submitting a proper form and jeopardising my legal stay in the UK. Do we have any clear written statements with the UKBA on this (and if you could share second Tier1 grant cases with the same FLRTier1 form), as in the guidance below they used the sentence: "Migrants who currently hold HSMP leave" and I am not sure how the caseworker will take my application based on that? Also, I would not be able to send my HSMP approval letter with the application as I have misplaced it years back but know that UKBA has that in their records on which basis they granted me the first Tier1 and did not ask me the Life in the UK test for ILR application.

The best solution would have been in person appointment, whcih are now not available (will continue searching for it), and may not be applicable for our case:

which states PEO not applicable for an extension of your visa on the highly skilled migrant programme.

This again is contrary to the fees mentioned for PEO service in FLRTier1 form by UKBA.

UKBA website says that PEO same day service is not available for HSMP extesion but two such examples are available and one of them had sought and got second extension:
