10 year long residence ILR eligibility

Post by Raviteja440 » Tue Sep 02, 2025 8:08 am

Hi,
Could you please advise if I'm eligible for ilr under 10 year long residence route.
Arrived UK on ICT Short term visa - Oct 12 2015
Left UK before expiry - 23rd May 2016 (visa expires on 30th May)
Returned UK on 23rd July 2016 on ICT Long term visa.
Has my continuous residence is maintained with the gap in visa between 23rd May 2016 to 23rd July 2016?

I do not see any issues.

Read: Lawful and continuous residence changes to Long Residence route from 11 April 2024
Thanks @Zimba, my concern is about the 53 day gap without visa during the from ICT short to long visa switch. May I know, if I have to spend the additional 53 days to meet 10 year period?

There is no gap. I already provided advice to you under that link. Read the item 3. It covers the exact question !

Many thanks.
One more question.. My application for private life route visa is pending with home office. Can I put down the new application for ilr now by varying?
Will the home office consider the new application date for ILR decision as the private life route application date does not fall in 28 days before 10 year mark. Please advise.

28-day concession has nothing to do with the application date

Sorry, I may not be clear.
My question is would the home office take the date of the existing application or the new application date of ilr if I 'VARY'?

Again, why do you think such a date is important ??
The 28-day concession has NOTHING to do with any of such dates, neither your pending application date nor the date of any variation

Hiya,
It's because, if they consider the previous application date, I'm doubtful if home office may consider it as an early ilr application.
If they consider the variation date then, it is not early. Hope I'm clear this time.
Any early application for ILR will be rejected by default which I don't want to be in that situation.

Consider it for what ?
None of those dates are relevant. They consider the date of ILR decision, so the date of the application is not relevant at all.

You still do not understand neither how the 28-day concession works nor how the qualifying period is calculated for ILR. I covered how it works under the links above and shared it twice, so I suggest you go and read it.
