1st British Passport for baby. Parent- dual national

Good morning,

I wonder if you could advise which way is the best to apply for baby’s 1st British Passport; baby was born in the UK.
Mother is dual EU and British national and father is from outside EU, residing in the UK on the EEA Family Permit.
If mother applies for childs passport based on her British Passport - is this ok since the father relies on mothers EU passport and rights, not British rights? A bit confused.

Your husband's status is completely irrelevant to the British passport application for a child.

Presumably you were already British at the time of the child's birth??

Thank you for such a prompt reply. Yeah, British before baby was born.
So, using British Passport in such situations is not making any issues? They will not ask husband to apply for British visa since he is married to EU/british? EEA Residence Card is sufficient and doesnt have to be swapped for British Visa, yes?

No. The baby is British if born to a British parent. There is no rule that both parents must be British.

This is completely irrelevant to the child's passport application.
