320 (7A) Rejection

Hi,

I am seeing advise on my brother's Student VISA under Tier-4 that is refused based on the following ECO decision. Please take some time to read it and advise as I am dealing with these issues first time and have no clue of what to advise to him:

General Grounds for Refusal

ECO Comment: In support of your application you have submitted a letter from FFFFFF Textile Mills ltd stating you worked there as an HR Executive in 2007. As as result of checks made by this office, detailed in a document verification report, I am not satisfied that this document is genuine. This fact has damaged not only your credibility but also that of the applicatoin as a whole and I am therefore not satisfied your intentions are as stated. As a false document has been submitted in relation to your application, it is refused under Paragraph 320(7A) of the Immigration Rules.

My brother was doing the job at FFFF Textile Mills ltd back in 2007 and he confirmed with FFFF Textile Mills ltd that Embassy did send a Fax for his job verification. But somehow the person who responded did not confirm due to confusion of the department and his name.

He contacted back to FFFF Textile Mills and they are agree to provide written confirmation about his job and the confirmation that did not confirmed his job due to the confusion when Embassy tried to verify.

My question is: -

1. Should he submit an EVIDENCE with Administratve Review, which he will get from FFFF Textile Mills ltd now about job confirmation and clarification about verfication checks Embassy made previously? Will they consider the evidence?

2. If he is not allowed to submit Evidence with Admin Review and if he just mention the facts and the dicision still remains same, Will he then be allowed to Appeal? Can he submit Evidence with Appeal then?

3. Can he submit fresh application and do not followup this current refusal? Is there any ban for him due to 320(7A)? Should he apply VISA with fresh application and mention the reason of last refusal in covering letter, supporting documents from university, from job and additianal documents from employer confirming job and the reason of why they did not verrified his job during last verification? Will they not refuse it again because he did not clarify the reason of refusal with last application?

The credibilty of the company will be questionable if they NOW have to provide details after refusal. Most especially if the country involved is one of those where such things are regularly "arranged".

Thanks for the reply. I think he has got All the payslips, Appointment letter, Employee card etc. As long as employer is confirming and acknowleding their mistake, there should not be problem?.
