3rd extension - Tier 1 (general)

I entered Tier 1 (HSMP) on August 2007, eligible for ILR on August 2012.
However, I have a non-recordable magistrate court fine for not paying road tax in November 2007. Therefore, I have decided to make one more extension under Tier 1 and apply for ILR after November 2012.

My question is:
Can I apply for an early extension or as the consultation period has ended, I cannot get more than 5 years extension under Tier 1?


I am applying early before the new rules comes in. Please advice, I am ready to apply in next 7 days.

Who says that you cannot get more than 5 years of extensions under Tier 1? Which "new rules" are you referring to?

Page 12,

"Consider capping the maximum period of Tier 1 temporary leave at 5 years and restricting the number of exceptional talent migrants granted settlement."

I understand that UKBA will not give more than 5 years temporary leave for Tier 1 - so if you have any convictions on the first year, you can't extend your Tier 1 after 5 years (third extension) to be eligible for ILR. This rules are not in place yet (I think)

This is not a new "rule". This is just the proposition in the consultation document (about which MAC, incidentally, said nothining about).

The point is, UKBA clearly said that they consider applying the changes only to those who entered PBS after April, 2011, and that they will be in effect only after April 2016.
