50K T1 extension regarding Job Creation (Director)

Hi all,

I have created a company with two partners, one is EU citizen, one is British back to July 2013 under my PSW visa.

I have switched my visa from PSW to T1 (50k) in July 2014 with the documents of this company.

I will extend my Visa in July 2017 and I am wondering do I need to provide another two 12 months full time work opportunities to any other British Citizens and EU citizens? or the two Directors who have established the company with me can be counted as the job opportunities I have created?

Both of them have been working from July 2013 until now and we will continue working together and the business has also been running successfully during the last three years.

Hope to hear your thoughts on this.

This is not really covered by immigration rules and there is nothing that prevents you from claiming them as employees. Be aware that in other parts of immigration rules (for example under Tier 2), an employee cannot own more than 10% of a company. I assume this to be risky and just as a suggestion, I recommend you to hire two more employees if possible to be safe.

Thanks very much Zimba88, I had a full time worked for me 5 months last year and another one has been working for 2 months now and continuing , don't really think I got time or chance to find another EU/UK worker to work for another 12 months as I have to renew July next year, all I can do is finger crossed and hopefully the directors will count as employees as it is a grey area.
