About Nationality

Post by erjonathan » Sat Dec 09, 2006 3:13 pm

Hi, I would like to know if you could help me in this case of nationality.
The thing is that my great grandfather was born in Scotland. My grandfather born in Brazil - 1928 and he has a British Passport which says that he has: British Subject by birth. He was registered when he born, in a British Consulate in Brazil. His daughter, who is my mother, born also in Brazil in 1954 but she didn't have the British passport.
I was born in 1980, in Brazil.

Reading the rules on the Home Office, I didn't find if I have the right to get the British Nationality through my grandfather. The information contained are confusing and I'm felling lost.

Any kind of help are welcome.

Thanks a lot.

Eric

Short answer : Sorry, no chance.

Longer answer:

After 1 January 1915, British nationality generally speaking didn't pass down beyond the first generation unless the birth was registered at a British Embassy.

Your grandfather was a British subject by descent. As your mother wasn't registered (apparently) then she had no British nationality.

Even if your mother had been registered as British (and then tried to register you in 1980) it wouldn't help you because prior to 1983, British nationality could not be passed down from a British mother.

And in any case, even if she could have done, you would not have had a Right of Abode in the UK (under the pre-1983 laws) and hence would have become a British Overseas citizen rather than a British citizen on 1.1.1983. British Overseas citizens have no special rights to live in the UK.
