Absence count for ILR

Post by ercekal » Mon Nov 09, 2020 9:17 pm

I have Turkish Business Person ECAA visa granted on 2 Feb 2017. I had my first extension on 19 Apr 2018.

Overall my absences were within the limits however during covid period I was out of UK extended time.

my travels were:
2019
20-26 March - 5 days
9-13 May - 3 days
29 May - 5 June - 4 days
26 June - 1 July - 4 days
24 July - 5 August - 11 days
22 Aug - 8 September - 15 days
2 - 7 October - 4 days
10 - 15 October - 4 days
2 - 25 November - 22 days

2020
5 March - 27 August - 174 days

Due to flight bans and other problems (covid positive family members, concerns for flying) my last rolling 12 months were about 220 days. Would this be a problem for my ILR application which is due to happen January 2022?

Thanks!

The absence due to pandemic has been incorporated in the Nationality guidance but not for ILR so far. This could be a problem as you have broken the continuous residency.
