I wonder if someone can give some guidance on my ILR application. I am completing 5 years continous period in Nov 2011 and applying for ILR in Oct 11.
I was on HSMP visa and got extension as Tier 1(General) under HSMP judicial review. My original application was in Oct 2006.
Due to my husband's illness, I have travelled abroad twice over the 5 years period.
1. In 2007 = (36 days paid leave)
2. In 2008 = (120 days - 16 days paid leave & 106 days unpaid leave)
During my unpaid leave, I was paid due to some confusion in my payroll. so on my payslips for that period, I have paid tax and NI which was later adjusted through working arrangement with my manager - TOIL. However, I have no proof of that arrangmenet and reason why I was paid even though I was overseas.
With regards to my husband's illness, I have a GP letter confirming my role as a carer and need for it. Also, I have the medical evidence to prove that treatment provided over here since 2007 was unsuccessful and that it was necessary to go due to deterioration in health.
My problem is I was paid for the 120 days leave from the UK and have payslips to prove it. however, I am unable to get a letter from my employer or payroll due to confusion in payments and the working arrangmeent made back in 2008.
Can someone please help.
