Absences from UK policy applicable for a child?

Post by Will_I_Get_ILR » Sun Jan 17, 2010 7:32 pm

Hello,

My 2 yr old son who was born in India got an ILR along with me and my wife in Jan last year!

I am looking at applying for naturalisation for all 3 of us towards end of Jan.

I understand that I would have to apply for my son under section 3(1) - to add to the complication, he has spent 105 days in last 1 year outside UK.

Is 90 days absences from UK policy applicable to children's application under section 3(1)?

Would it be advisable to apply for my son separately after 7-8 months when his absence period in last 12 months would have become less than 90 days?

Thanks

it should not be a problem. if you are granted your child should also be granted. I think the residence requirement are mainly for those applying under section 3(2). i am not sure if they have to meet the 90day requirement as well
