My daughter obtained a Accompanied Child Visit visa last year from the UK embassy in Manila, to go to the UK visit her grandparents. We actually applied for a general Family Visit visa, but were issued an Accompanied Child Visit visa, with both me and my wife's passport numbers on. It also says "Only Valid If Accompanied by xxx xxx".
We used the Visa to travel to the UK. We stayed for two weeks, and decided that my daughter would stay with her grandparents for two further months, as the grandparents loved her company so much. My daughter then left the UK within the validity period of her visa, with her grandparents.
It didn't feel anything wrong at the time, as it felt like the totally natural thing to do, to decide that the girl would stay a bit longer to enjoy time with her grandparents. But on hindsight, I got terribly worried that me and my wife left the UK before our daughter.
We are now planning to visit the UK again. But I am very concerned that this last visit has caused a problem. I looked through all the laws and regulations, and it is not clearly stated anywhere that the parents (named on the daughter's visa) have to be with the daughter throughout the whole visit, and also leave with the daughter. It simply says that the child have to be accompanied to the UK by the persons named on the visa. We did that, we travelled to the UK together; but we just left before our daughter did.
Please, can someone advice whether the British Embassy would regard that my daughter broke the condition of her previous stay, and would this cause a refusal of future visa application? What argument we can put forward to explain this? Will they likely to accept that a genuine confusion exist as the law is not very clear? After all, we all left the UK within the visa validity.
Also, we did apply for a general Visit visa for our daughter. But it was changed to Accompanied Child visa, and there was no explanation as to any change of the condition of stay to us. Can this be used as an argument?
I will appreciate it greatly if anyone can share their views/experiences. I am terribly worried now... Many thanks
