Hi all,
I’m a Brazilian citizen living (5 years) and working (3 years) in Uk under a tier 2 visa. I was previously under a tier 4 / student visa for 2 years and now on the tier 2 for 3.
My question is: last year I’ve had my Italian citizenship recognised due to ‘jus sanguinis’.
Now, my tier 2 visa is about to expire (2 months) and I wish to renew it again for up to 3 years and later on apply for a permanent residency.
I qualify for all the requirements, however, I’m worried that the fact that I now have an EU citizenship might block or cancel my right to apply for a Tier 2 extension (in fact, when filling up the forms for the Tier 2 visa, they ask if I currently hold or have ever held a second citizenship and ask for details about it).
In light of the Brexit and all the uncertainties regarding the rights of EU members to remain in UK, I do not want to switch my status from Brazilian to European, as under my Tier 2 I only need 2 more years in the country in order to be able to apply for a settled status, whereas as an European, all these years I’ve been living and working in UK would probably not count and this switch might in fact be worst for my situation.
I doesn’t even have an Italian passport yet, as this is still being processed by Italian consulate and my current visa is about to expire soon.
I’m worried to discuss this issue with my employer, as they might be lured by the possibility of not having to sponsor me anymore, so I’m trying to work out all the possibilities and problems I nght have when renewing my current visa.
Is there anyone on the same situation or with a good advice about my case?
