Additional Documents for IAFT-2 Appeal

Hi All,

My wife has applied for leave to enter as a dependent of a settled person (myself). Unfortunately, her application has been refused as she did not provide enough supporting documents with regards to the financial requirements (only 2 payslips were sent with the application - this was a serious oversight). She has been given the right to appeal on IAFT-2 form.

My question is, can we use the appeal procedure and provide more documents (6+ months payslips/bank statements and an employer letter) to demonstrate that we meet the financial requirements, or do we have to make a fresh application?

You can go for an appeal and they have 28 days to review and in many cases they will overturn the decision. .

I hope you had the six months employment before you applied? Coz you will need to seek permission to rely on evidence that became available after the application had been lodged.

Thank you so much for the response Obie. This is a relief! Yes, I had been in full-time employment for 5+ years prior to the application, so that shouldn't be an issue. I just wasn't sure if we could use additional evidence that was omitted in the original application.

You mentioned 28 days - are they obliged to respond within this timeframe?

They are. If you have a rep , he or she will explain this to you .

Unfortunately, we don't have a rep. I have just submitted the appeal online and sent the supporting documents to the Tribunal by post. Just to make sure I understand your statement above correctly - does the ECM have 28 days to review the case after the Tribunal sends it to the Embassy? I read in another forum that they have 19 weeks to review!! I'm trying to put a timeline on this but can't find any information in the HO website.

Yes, I have seen similar posts online, hence my question to Obie as to where the 28 days is stated.
