ILR application for Tier 2 general dependent child

Post by sivalsm » Tue Aug 18, 2020 3:39 pm

Hi,
I came to UK on Tier 2 General and I got ILR on Jan 2020.

My wife and daughter came to UK in 14 August 2015.

I already applied ILR for my wife as she completed her 5 years stay. Application is under progress.

Now i'm planning to apply ILR for my daughter as well.

My question is, can i apply ILR for my daughter without having ILR for my wife?

Thanks,
Siva

Why didn't you apply for your daughter or include her with your spouse's application? That would have been the simplest thing to do.

The child will NOT qualify for or get ilr if your wife is not granted ilr. The rules don't permit this.

Thanks for your reply.

I always file different applications for my wife and daughter. No specific reasons. I thought my daughter will be eligible for ILR automatically once after she finishes 5 years stay.

Is there any way to add my daguhter to my wife's application, payment already made.. waiting for mail (app to upload documents) :-)

There is nothing automatic. There is also no 5 year residence requirement for children. They can simply apply with the parent(s) when they apply, regardless of how long they have been in the UK.

No there is not. She would have been included and added as a dependent in your wifes' application and two payments made and biometrics invite would have been together. You will now have to make a separate application for the child alone.

You should still keep a contact at your old address if possible. You can not risk with official mail sent to previous address in error.
