Hi

I am from Srilanka currently in uk in student visa,

I got an employer who has got permission from home office for work permit letter for 5 yrs for me to be their employee

I was in the process to apply for FLR IED , came to know that i cant switch my student visa to work permit inside uk [ since i have not completed my Msc degree at Uk], I need to go to my home country,

So my employer has to apply again for the work permit out of country letter, But the advertisement for the vacancy of my post is going to be exactly six month on coming saturday ,(11th nov)

And my employer says that they will apply middle of this month, So will there be exception of six month advertise in my case..

Since I already got a in country work permit but i need a out of country work permit so how will case be considered my the home office.

My friend has passed through exactly the same situation when he was doing his degree and got a job with an employer. The employer got In-Country approval letter for him from wp uk. But he was given leave to remain within the uk so he had to leave the country then his employer applied for out of ocuntry workpermit document that was granted and sent to my friend to his country and he applied for entry clerance that was finally granted to him. Now he is successfully working with the same employer.

Now the procedure, his employer adopted in getting the out country wp doc is:

Employer phoned work permit uk and asked them that he has already passed through the wp procedure and obtained the in-country wp letter but because the HO has refered the candidate to his local british high commission for entry clearance because of not yet completing the degree, so what he has to do for getting out country wp doc.

Employer was told by wp uk that they do not have to pass through the same procedure and submit all those documents again that were submitted before and are required to submit with fresh application. Instead, to get out country wp, the employer has to submit a fresh application i.e wp1 alongwith the fee, in-country wp approval letter, and the HO letter referring the candidate to his local british high commission for entry clearance. The employer also need to mentioned the incountry wp letter's reference number on wp1 form and also makes a covering letter detailing all the story.

The same was done by his employer and sumbitted the application and work permit arrived in one week time.

I hope that this would help you in persuing your case.

Sorry he was not given leave to remain with the uk cos he had not completed his degree at that time.

Dear georgeedwin,

I have EXACTLY the same problem as yours!
to make thing worst ... my work permit was granted in Sept 06 -- expired 6 mths later (March 06). I got a job when I'm writing my Phd thesis few months back, I have not graduated my study yet as I'm having problems with my thesis, and I can't have my final Viva presentation for another 3 months.. that means I may risk losing the work permit then!

I'm now considering what suggested by joshuabrook to get my employer apply the out of country wp for me. Finger crossed!

I have further questions, hope you don't mind, is this a 'normal procedure' that home office usually do? It seems like I'm trying to get around the rules and getting the Visa without having my degree done?

I don't understand this statement "the HO has refered the candidate to his local british high commission for entry clearance", Where can I get this HO referral (or letter)?

Thanks for ur reply especially to ch15 who shares his experience.

My status now is my employer applied again for out of country wp through solicitors

Came to know through my solicitor is that the pay seems to be not up to the level but the things is i am placed in scotland nothern side in a small village ,so they cant compare pay with that to big cities.

So hope things will go fine, my solicitor even raised the issue saying my previously wp has been issued but why you are raising concern now , the reply was they might have not noticed properly and more over they are coming up saying they can change their decision for each new application rather you applied before.

So waiting to see how things go around
