Advice on extension using FLR (M)

Dear Board Members,

I am a British national (obtained through Tier 1 General) and would like experienced member’s opinion on following,

Background Info:

- My family (1 spouse & 3 children) was granted settlement visa in April 2015 for 33 months. Their extension is due in Dec 2017 and will be applying through FLR(M).
- All my children were under 18 when I applied for their visa from Pakistan.
- Current age of children is 20, 18 and 13.
- I am renting a 2 bedroom flat through private landlord. Property details are, Room 1 (11`X 9`), Room 2 (12.8`X 11.6`) and a living room (16` X 12`). All measurements are in feet.
- My basic salary is GBP 25,200 per annum, but when I include bonus and overtime, this figure then becomes around ~35K per annum. All this amount is taxable and shown on salary slip and being credit of account.

The queries based on above information are,

Query 1:

- Is this apartment fulfil housing requirement (space per person, rooms and overcrowding clauses of 1985 Housings Act)?
- What is required from local authority or estate agent in terms of certificate or document that no objections for my family to stay in this flat.

Query 2:

All my children were under 18 when I applied for their visa. My eldest son who will be 20 at the time of visa extension went back to Pakistan for 5 year medical studies. During the last two years, my son has hardly spent 6 months in UK.
This situation will continue for next four years until his medical studies have been completed.

Please advise if,

- I apply for his extension or not?
- If I do apply, what documents/justification will be required?
- If I do not apply for his extension now, can I apply later after the completion of his medical studies?


Query 3:


If I apply for all my family i.e. 3 children and a spouse, does my salary meet the criteria?
I know my basic salary is short of £1800, Can I include my overtime and bonus since it is taxable income and if I do, which option from the chart would I select? i.e. Option A? or a combination of any other options?

I would appreciate your response and feedback to above info.
